DES:d~k 1' '15/89 (003/26) <br /> - DES:~. 1~ 21/89R <br /> <br />1. This Board hereby finds, determines and concludes as <br />follows: <br /> <br /> (a) The project described in the Lease Agreement <br />hereinafter approved is exempt from the provisions of CEQA <br />pursuant to Section 15301 ("Existing Facilities") of the State <br />CEQA Guidelines (14 Cal. C.of Regs. 15000 et seq.). <br /> <br /> (b) Notwithstanding finding (a), above, the aforementioned <br />EIR prepared by the South Bayside System Authority, as lead <br />agency, for the prior proposed project has been reviewed by this <br />Board. <br /> <br /> (c) This Board hereby finds that, in accordance with the <br />aforesaid EIR, provisions have been incorporated into the project <br />described in the lease hereinafter approved which avoid or <br />substantially lessen any significant environmental effect <br />identified in the final EIR as follows: <br /> <br /> (i) Mitigation with respect to geology, soils and <br /> seismicity shall be as follows: all plans for new <br /> construction on the site shall be developed in <br /> accordance with site specific seismic design <br /> requirements prepared by a registered engineering <br /> geologist, and cleanup protocols for accidental spills <br /> established by the Department of Health Services and/or <br /> the Regional Water Quality Control Board shall be <br /> carefully followed in order to minimize risks of soil <br /> and ground water contamination (ref., EIR, p.28). <br /> <br /> (ii) Mitigation with respect to air quality shall be <br /> addressed through the permitting and inspection <br /> <br /> 4 <br /> <br /> <br />
