Liability for bodily injury, personal <br /> y Y J rY p <br /> injury, and property damage <br /> Automobile Liability N/A <br /> Property -Fire Replacement value of <br /> the improvements <br /> Concurrently with the execution of this Agreement, CHDO shall furnish City with <br /> certificates and endorsement copies of information or declaration pages of the <br /> insurance required hereunder and, with respect to evidence of comprehensive <br /> general liability and automobile liability insurance (if applicable) coverage, <br /> original endorsements: <br /> a. Precluding cancellation or reduction in coverage before the expiration of <br /> thirty (30) days after City shall have received written notification of <br /> cancellation or reduction in coverage by first class mail; <br /> b. Providing that CHDO's insurance shall apply separately to each insured <br /> against whom claim is made or suit is brought, except with respect to the <br /> limits of the insurer's liability (cross liability endorsement); <br /> c. Naming the City, its officers, boards, commissions, employees, and agents, <br /> as additional insureds; and <br /> d. Providing that CHDO's insurance coverage shall be primary insurance with <br /> respect to City, its officers, boards, commissions, employees, and agents, <br /> and any insurance or self- insurance maintained by City for itself, its officers, <br /> boards, commissions, employees, or agents shall be in excess of CHDO's <br /> insurance and not contributory with it. <br /> 6. NON - DISCRIMINATION <br /> CHDO shall comply with the non - discrimination requirements described below: <br /> a. Section 504 of the Rehabilitation Act of 1973 <br /> (1) Pursuant to Section 514 (Public Law 93 -112), the CHDO agrees that <br /> no otherwise qualified persons with disabilities shall, solely by reason <br /> of a disability, be excluded from the participation in, be denied benefits <br /> of, or be subjected to discrimination in the performance of this contract <br /> or in the selection of low income owners to purchase the dwelling to be <br /> built on the "Property." <br /> (2) Compliance of Section 504 of the Rehabilitation Act of 1973, as <br /> amended, requires that all benefits, aids and services are made <br /> ' Property-Fire insurance policy shall become effective no later than the date of notice to proceed is given to the <br /> general contractor for work covered under this agreement. <br /> ATTY/AGR/2010.064 4 <br /> 072910 <br />
