d. Nondiscrimination Based on Disability. <br /> CHDO hereby agrees that it will comply with the provisions of Section 504 of <br /> the Rehabilitation Act of 1973, as amended, providing equal access and <br /> reasonable accommodations in employment programs and services to <br /> persons who are disabled. <br /> e. Interest of Public Officials. <br /> No members, officers, employees, or agents of City and no other public <br /> official who exercises any function or responsibility with respect to this <br /> Agreement or CHDO's Program during his or his tenure, or for one year <br /> thereafter, shall have any interest, direct or indirect, in this contract or a <br /> related subcontract, or the proceeds thereof. CHDO shall incorporate in all <br /> subcontracts hereunder a provision prohibiting such interest. <br /> f. Religious Activity Prohibited. <br /> Those shall be no religious worship, instruction, or proselytizing as part of, or <br /> in connection with, the performance of this Agreement. <br /> g. Uniform Administration Requirements. <br /> CHDO shall comply with the requirements and standards of the HOME <br /> Investment Partnership Regulations, OMB Circular A -122 Cost Principles for <br /> Non - Profit Organizations, OMB Circular A -110 attachments A, B, C, F, H, N, <br /> and 0, and all other federal, state, and local laws, regulations and <br /> requirements, as applicable. <br /> h. HOME PROGRAM Requirements. <br /> CHDO shall comply with the requirements and standards of the HOME <br /> Investment Partnership Regulations relating to: income targeting to HOME <br /> limits of 50% and below median income; affordability term of no less than 15 <br /> years; Contractor shall set unit HOME rents at the rates listed below. Said <br /> rents shall not exceed 30% of the household's gross income. Monthly <br /> housing costs shall be defined as rent plus utilities. <br /> 7. ASSIGNMENT AND SUBCONTRACT <br /> Without the written consent of the City or its representative, this Agreement is <br /> not assignable in whole or in part. Any assignment by CHDO without the written <br /> consent of the City or its representative violates this Agreement and shall <br /> automatically terminate this Agreement. <br /> 8. RECORDS <br /> CHDO agrees to provide to City, and to any Federal or State department having <br /> monitoring or reviewing authority, and /or their appropriate audit agencies upon <br /> reasonable notice, access to and the right to examine and audit all records and <br /> documents necessary to determine compliance with relevant Federal, State, and <br /> ATTY /AGR/2010.064 6 <br /> 072910 <br />
