4.1 Permitted Uses. The Premises shall be used and occupied only for the
<br /> following purposes (the "Permitted Use ") and for no other use or purpose whatsoever: retail,
<br /> industrial, wholesale, and construction.
<br /> 4.2 Compliance with Law. Tenant shall accept possession of the Premises
<br /> in their condition existing as of the date of Landlord's delivery of possession thereof to Tenant,
<br /> subject to all laws, ordinances, codes, rules, orders, directions and regulations of lawful
<br /> governmental authority (collectively, "Applicable Laws ") regulating the use or occupancy of the
<br /> Premises, and all matters disclosed by any exhibits attached hereto. Tenant, at Tenant's sole
<br /> expense, shall promptly comply with all Applicable Laws as may now or hereafter be in effect
<br /> relating to or affecting the condition, use or occupancy of the Premises. Without limiting the
<br /> foregoing, Tenant shall obtain all permits, clearances or other authorizations required from the
<br /> City of Redwood City and all other applicable governmental agencies and authorities required for
<br /> Tenant's use and occupancy of the Premises.
<br /> 4.3 Restrictions on Use. Tenant shall not use or permit the use of the
<br /> Premises in any manner that will tend to create waste on the Premises or constitute a nuisance to
<br /> any other occupant or user of the Building(s) or any other portion of the Property or adjacent
<br /> thereto or do or keep anything that will cause cancellation of or an increase in rates of any
<br /> insurance covering the Building(s). Tenant shall not use any apparatus, machinery, or other
<br /> equipment in or about the Premises that may overload existing electrical systems, and shall not
<br /> place any loads upon the floors, walls, or ceilings of the Premises which may jeopardize the
<br /> structural integrity of the Building(s) or any part thereof. Tenant shall not make any penetrations
<br /> of the roof or exterior of the Building(s) without the prior written approval of Landlord. No
<br /> materials or articles of any nature shall be stored outside of the Building(s) unless such storage
<br /> complies with all Applicable Laws and governmental requirements and the rules and regulations
<br /> set forth in Exhibit B hereto.
<br /> 4.4 Hazardous Substances.
<br /> (a) Reportable Uses Require Consent. The term, "Hazardous
<br /> Substance," as used in this Lease, shall mean any product, substance, chemical, material, or
<br /> waste whose presence, nature, quantity, and/or intensity of existence, use, manufacture, disposal,
<br /> transportation, spill, release, or effect, either by itself or in combination with other materials
<br /> expected to be on the Premises, is either: (i) potentially injurious to the public health, safety or
<br /> welfare, the environment, or the Premises; (ii) regulated or monitored by any governmental
<br /> authority; or (iii) a basis for potential liability of Landlord to any governmental agency or third
<br /> party under any applicable statute or common law theory. Hazardous Substance shall include,
<br /> but not be limited to, hydrocarbons, petroleum, battery acid, gasoline, crude oil, or any products
<br /> or by- products thereof. Tenant shall not engage in any activity in or about the Premises which
<br /> constitutes a Reportable Use (as hereinafter defined) of Hazardous Substances without the
<br /> express prior written consent of Landlord and compliance in a timely manner (at Tenant's sole
<br /> cost and expense) with all Applicable Laws (as defined in Section 4.2). "Reportable Use" shall
<br /> mean (i) the installation or use of any above or below ground storage tank, (ii) the generation,
<br /> possession, storage, use, transportation, or disposal of a Hazardous Substance that requires a
