APPENDIX D <br />DEPENDENT CARE ASSISTANCE PLAN <br />Participation <br />An Employee shall become a Participant in the Plan for purposes of Section 4.2 relating to the <br />reimbursement of dependent care expenses by electing to have his compensation reduced by an <br />amount as specified in Appendix A, and to have such amount credited to the DCAP. <br />Establishment of Account <br />The Company shall establish and maintain on its books, a separate Dependent Care Assistance <br />Account for each Plan Year with respect to each Participant who has elected to have his <br />compensation reduced pursuant to Section 4.2 for such Plan Year. This account shall not be co- <br />mingled with any other accounts established pursuant to the Plan. <br />Reimbursement of Dependent Care Expenses <br />The Company shall reimburse each Participant from the Participant's Dependent Care Assistance <br />Account for dependent care expenses incurred during the Plan Year for which the Participant <br />submits written documentation in accordance with Section 5.1. No reimbursement of expenses <br />incurred during a Plan Year shall at any time exceed the balance of the Participant's Dependent <br />Care Assistance Account at the time of the reimbursement. The amount of any dependent care <br />expenses not reimbursed as a result of the preceding sentence shall be reimbursed at a later date <br />during the Plan Year only if and when the balance in the Participant's Dependent Care Assistance <br />Account permits such reimbursement, but not including amounts contributed to the Dependent <br />Care Assistance Account after the end of the Plan Year. <br />Forfeiture of Accounts <br />The amount credited to a Participant's Dependent Care Assistance Account for any Plan Year <br />shall be used only to reimburse the Participant for dependent care expenses incurred during such <br />Plan Year. The Participant must apply for reimbursement before the 90th day following the close <br />of such Plan Year (or before the 90th day following the termination of the Employee's <br />participation in the Plan). If any balance remains in the Participant's Dependent Care Assistance <br />Account for a Plan Year after all reimbursements are made, such balance shall not be carried over <br />to reimburse the Participant for dependent care expenses incurred during a subsequent Plan Year, <br />but shall be forfeited. <br />Dependent Care Expenses <br />The Company shall reimburse each Participant for those dependent care expenses that are <br />permitted under Section 129 and related sections of the Code. <br />17 <br />
