6. 1 ��- 1(3 <br />APPENDIX C <br />MEDICAL EXPENSE REMBURSEMENT PLAN <br />Participation <br />An Employee shall become a Participant in the MERP for purposes of Section 4.2 relating to the <br />reimbursement of medical expenses to allocate a portion of his City Contribution to the MERP and/or by <br />electing to have his compensation reduced by an amount as specified in Appendix A, and to have such <br />amount credited to the MERP. <br />Establishment of Account <br />The Administrator shall establish and maintain on its books, a separate Medical Expense <br />Reimbursement Account for each Plan Year with respect to each Participant who allocated a portion of <br />his City Contribution to the MERP or who has elected to have his compensation reduced pursuant to <br />Section 4.2 for such Plan Year. This account shall not be co- mingled with any other accounts established <br />pursuant to the Plan. <br />Reimbursement of Health Care Expenses <br />The City shall reimburse each Participant from the Participant's Medical Expense Reimbursement <br />Account for health care expenses incurred by the Participant, his Domestic Partner and any Dependents <br />during such Plan Year for which the Participant submits written documentation in accordance with <br />Section 5.1. No reimbursement under this Plan for expenses incurred during a Plan Year shall at any <br />time exceed the annual amount elected under the Participant's Medical Expense Reimbursement <br />Account for the Plan Year. <br />Forfeiture of Accounts <br />The amount credited to a Participant's Medical Expense Reimbursement Account for any Plan Year shall <br />be used only to reimburse the Participant for health care expenses incurred during such Plan Year. The <br />Participant must apply for reimbursement before the 90th day following the close of such Plan Year (or <br />before the 90th day following the termination of the Employee's participation in such Plan Year). Any <br />amount that remains in the Participant's Medical Expense Reimbursement Account for a Plan Year after <br />all reimbursements are made, such balance shall not be carried over to reimburse the Participant for <br />health expenses incurred during a subsequent Plan Year, but shall be forfeited, and shall not thereafter <br />be available to the Participant in any other form or manner. <br />Health Care Expenses <br />The City shall reimburse each Participant for those expenses which are permitted under Section 213 and <br />related sections of the Code. <br />16 <br />
