�.ie - s <br />APPENDIX B <br />PREMIUM CONTRIBUTION PLAN <br />Participation <br />An Employee shall become a Participant in the Premium Contribution Plan for purposes of <br />Section 4.2 relating to the purchase of Qualified Benefits when he becomes eligible for <br />coverage under a health plan sponsored by the City. <br />Premium Payments <br />Payments under this Premium Contribution Plan will be made to provide health coverage for the <br />Participant and, at the Participant's election, his Domestic Partner and any Dependents. <br />Accounts <br />The City shall create and maintain separate payroll accounts on behalf of each Participant who <br />elects to have premium contributions made to the Plan for the Qualified Benefits. These payroll <br />accounts shall not be co- mingled with any other accounts established pursuant to the Plan. <br />Return or Recharacterization of Contributions <br />Notwithstanding any provision of this Plan to the contrary, in the event the Plan Administrator <br />determines that the Plan may be discriminatory under the Code a Participant's Salary Reduction <br />Agreement may be disregarded to the extent necessary to prevent such discrimination and, as a <br />result, the amount of pre -tax premium contributions which would otherwise have been made <br />pursuant to such election may instead be (a) paid directly to the Participant as additional <br />compensation, or (b) recharacterized as after -tax Employee Contributions, which are voluntary <br />nondeductible Employee contributions. <br />15 <br />
