Commissioner Seybert wanted to add this wording to make sure that <br />there would be other areas for landscaping such as on roof tops. <br />Commissioner McCoy asked how the City can resolve disputes on the Precise <br />Plan between the City and developer. Mr. Alsman stated that it can be worked <br />out during the negotiation process. The Planning Commission has the power to <br />interpret the Precise Plan and its decision can be appealed to the City Council. <br />The Assistant City Attorney stated that the enabling ordinance for the "P" Zone <br />allows for any disagreement between the staff and developer to be appealed to <br />the Planning Commission. Any disagreement with the Planning Commission can <br />then be appealed to the City Council. <br />Motion passes 7 -0 <br />Commissioner McCoy asked staff to put on future agendas possible <br />modifications to extend this particular Precise Plan to adjoining areas and look at <br />the same concept after review of the Downtown Plan. <br />Mr. Passanisi said that the Commissioners decision on the Mitigated Negative <br />Declaration can be appealed to the City Council in seven calendar days. <br />MATTERS OF COMMISSION INTEREST <br />• Mr. Passanisi said that there will be a study session on Monday <br />December 2n with the City Council, Architectural Review Committee and <br />Planning Commission to talk about Downtown. <br />• On December 17 staff is going to talk about the Downtown Area Plan. <br />He said that staff needs to start moving on the implementation and <br />finalizing of the content. <br />• There will be a guest speaker to discuss the City's park needs sometime <br />in January. <br />• Mr. Passanisi reminded the Commissioners that they need to RSVP for <br />the Mayor's Christmas party. Mr. Passanisi said that staff will be working <br />on the dinner Christmas party for the Commissioners. The consensus <br />was that it would be on December 3' at 7:00 PM. <br />• Susan Moeller, Downtown Manager said that we have 21 companies and <br />organizations that responded to the Gingerbread Houses contest. On <br />December 3n' there will be a ceremony /press conference at 1 p.m. and <br />everyone is invited.
