4,1310 <br />evaluate the quality, appropriateness and timeliness of services <br />performed. <br />B. Contractor shall maintain and preserve all records and documents <br />relating to this Agreement, which become in Contractor's <br />possession and /or in the possession of any third party performing <br />work related to this Agreement for a period of three (3) years from <br />the termination date of this Agreement, or until audit findings, if <br />any, are resolved, whichever is greater. <br />9. COMPLIANCE WITH APPLICABLE LAWS <br />All services to be performed by Contractor pursuant to this Agreement <br />shall be performed in accordance with all applicable Federal, State, City laws, <br />City and Agency ordinances, and regulations, including but not limited to <br />appropriate licensure, certification regulations, and provisions pertaining to <br />confidentiality records, and applicable quality assurance regulations. <br />10. LEAD -BASED PAINT <br />The use of lead -based paint is prohibited on residential property. This <br />Project is required to test for lead based paint. Title X of the Housing and <br />Community Development Act of 1992, Section 1012 and 1013 amended the <br />Lead Based Paint Poisoning Prevention Act of 1971 now appears within Title 24 <br />CFR Part 35 is the basic law covering lead -based paint in federally associated <br />housing. This project requires a Lead Based Paint Inspection and Risk <br />Assessment by an ADHS Certified Inspector with random testing, to include all <br />painted surface components, dust wipe samples and soil samples. Stabilization <br />and or abatement shall be conducted by DHS certified contractors and qualified <br />workers prescribed by law. <br />11. MONITORING <br />All services performed and payments made pursuant to this Agreement <br />shall be monitored according to the protocols set forth in Exhibit A. <br />12. PROGRAM SPECIFIC REQUIREMENTS <br />Program specific requirements are contained in Exhibit A. <br />13. ALTERATION OF AGREEMENT <br />This Agreement is entire and contains all the terms and conditions agreed <br />upon by the parties. No alteration or variation shall be valid unless made in <br />writing and signed by the parties hereto, and no oral understanding or agreement <br />shall be binding on the parties hereto. <br />3/3/2DD3 8 <br />
