CITY OF REDWOOD CITY - DOWNTOWN RETAIL - CINEMA PROJECT ON BROADWAY S A / -7- <br />(2) A Fixed Payment In Lieu of a Payment For Actual Reasonable Moving and <br />Related Expenses: <br />The amount of this payment shall be based on the average, annual net earnings <br />of the business. The payment to an eligible business may not be less than <br />$1,000, nor more than $20,000. <br />To qualify for this payment a displaced business: <br />• Cannot be a part of a commercial enterprise having at least three other <br />establishments which are not being acquired by the City and which is under <br />the same ownership and engaged in the same, or similar business <br />activities; and <br />• Must not be able to relocate without substantial loss of patronage; and, <br />• Must have contributed at least 33% of the owner's total gross income <br />during each of the two (2) taxable years prior to displacement, or meet <br />specific earnings criteria. <br />1. EVICTION POLICY <br />Once the City has acquired the property on which the Project site is located, the City <br />may permit the business to remain as a tenant of the City until the property is put to use <br />forthe Project. Eviction of tenants is only permissible as a last resort. Eviction will only <br />take place in cases of nonpayment of rent, serious violation of the rental agreement, <br />performance of a dangerous, or illegal acts in the unit, the refusal of reasonable offers <br />of comparable replacement sites, or refusal to vacate the premises after required notice <br />from the City to vacate. <br />J. APPEALS POLICY /GRIEVANCE PROCEDURES <br />The appeals policy will follow the standards described in Section 6150 et seq., of the <br />State relocation guidelines. Displacee businesses are provided the right to ask for <br />review concerning rights to relocation assistance eligibility; the amount of a payment; or <br />the failure to provide advisory services. <br />PREPARED BY: PACIFIC RELOCATION CONSULTANTS (PRC) PAGE 11 <br />
