SB 110 authorizes a bid <br />specification of a certain product if the awarding <br />authority makes a finding that a particular material <br />or service is designated by a brand or trade name <br />in order to (1) obtain a genuinely necessary and <br />unique item'that is only available from one source, <br />(2) obtain an item under circumstances in which <br />competition is completely unavailing, or (3) respond <br />to a local or state declared emergency. Also <br />declares that the changes made by this bill codify <br />existing California case law. This bill is similar to AD <br />2666 (Mountjoy) of last year. The sponsor is the <br />Engineering Contractors' Association. Sales <br />and Use Tax. ACA 7 authorizes a county, city and <br />county and regional transportation agency to <br />impose an additional sales and use tax for a period <br />of 20 to 30 years at a rate of 0.5% exclusively for <br />transportation purposes within the jurisdiction of the <br />county, city and county or regional transportation <br />agency if the additional tax is approved by 55% of <br />the voters. ACA 7 requires the revenues from <br />these taxes be deposited in the Local Transporta- <br />tion Infrastructure Account to be used for specified <br />transportation purposes. Trans & Smart Growth Planning. <br />The California Constitution conditions the imposi- <br />tion of a special tax by a city, county, or special <br />district upon the approval of 2/3 of the voters of the <br />city, county, or special district voting on that tax, <br />and prohibits these entities from imposing an ad <br />valorem tax on real property or a transactions or <br />sales tax on the sale of real property. SCA 2 would <br />authorize a county, a city and county, a local <br />transportation authority, or a regional transporta- <br />tion agency, as defined, with the approval of a <br />majority of its voters voting on the proposition, to <br />impose a special tax for the privilege of selling <br />tangible personal property at retail that it is other- <br />wise authorized to impose, if the tax is imposed <br />exclusively to fund transportation projects and <br />services and smart growth planning, as defined. <br />CSAC and the League strongly support the need to <br />retain the current revenues generated from the <br />existing transportation sales taxes that are due to <br />expire, as well as, the opportunity for additional <br />counties to impose such a tax. SCA 2 by reducing <br />the voting threshold would provide critical revenues <br />to transportation at a great time of need. However, <br />we must express serious concern with the provision <br />that would mandate in every county the expenditure <br />of 25 percent of the monies for smart growth <br />HOUSING AND LAND USE <br />AD 980 (Salinas). Production -Based Hous- <br />ing Element Self Certification. AB 980 is a <br />production -based certification bill developed by the <br />League of California Cities' Housing Opportunity <br />Task Force. The legislation would authorize <br />communities that are producing, or have committed <br />to produce, at least 15% of its assigned low or very <br />low regional housing needs allocation to adopt <br />certify its housing element, without sending it to the <br />Department of Housing for additional review. The <br />jurisdiction will also have to make findings, based <br />upon substantial evidence, that its housing element <br />also complies with the key components of housing <br />element law. <br />On April 9, AS 980 was heard before the As- <br />sembly Local Government Committee. Susan Lien, <br />a San Bernardino City Council member and mem- <br />ber of the League's Housing Opportunity Task <br />Force testified in support of the bill along with a <br />number of other local government representatives. <br />Although suggestions for fine- tuning the bill's 15% <br />provision were considered during the hearing, AD <br />M was approved by the Committee by a convinc- <br />ing 6 -0 margin.
