q.A -28 <br />Legislative Bill Action <br />................................ ............................... <br />The following are summaries of just a few of the legislative bills that are currently being acted upon <br />by the League of California Cities. Use Tax. Vehicles, Vessels <br />and Aircraft. Currently, Californians can avoid <br />paying use tax if they purchase a motorhome, <br />yacht, or airplane just across the state border and <br />use it there for 91 days and then bring it into <br />California for its intended purpose. AB 694 will <br />require Californians to pay use tax if the property is <br />subject to vehicle registration or property taxes and <br />the vehicle, boat or plane was stored or used more <br />than half time in the first 12 months of ownership. <br />Staff: Jean Korinke, Status: AsRevTax; Hrg -4/21. <br />Position: Support. <br />TRANSPORTATION AND PUBLIC WORKS <br />AB 789 (Mountjoy). Vehicles. Removal. Local <br />Ordinance. Existing law authorizes a city, county, <br />or city and county to adopt an ordinance establish- <br />ing procedures for the removal of abandoned, <br />wrecked, dismantled, or inoperative vehicles from <br />private or public property. An ordinance establish- <br />ing procedures for the removal of abandoned <br />vehicles is required. AB 789 requires this ordi- <br />nance to exempt a vehicle that is completely en- <br />closed within a building in a lawful manner where it <br />is not visible from the street or other public or <br />private property. A vehicle meets these require- <br />ments if it 1) has a certification of nonoperation on <br />file with the Department of Motor Vehicles; 2) is <br />stored or parked in a lawful manner on private <br />property; and 3) is not readily visible from the <br />street. AB 1408 provides that it is not <br />a violation of the red signal provisions in existing law <br />for a person operating a bicycle and approaching <br />an intersection that has an official traffic control <br />signal equipped with a vehicle sensing device that is <br />not capable of being activated by the bicycle and <br />operator to stop at the intersection and, after <br />completing that stop and determining that there is <br />no other traffic at the intersection capable of acti- <br />vating the sensing device, to proceed with caution <br />when it is safe to do so. AB 1717 eliminates certain reporting <br />requirements and revises other reporting require- <br />ments for the expenditure of transportation capital <br />funds and describes the powers and duties of the <br />Department of Transportation and the California <br />Transportation Commission. AB 1717 revises the <br />routes descriptions for certain state highway seg- <br />ments to local agencies. Additionally, AB 1717 <br />repeals provisions relating to implementation of the <br />computerized cockpit instrument display and autho- <br />rizes certain airport planning functions to be funded <br />from nonfederal sources. AB 1717 identifies Elk <br />Grove and Rancho Cordova as additional cities that <br />may be annexed to the Sacramento Regional <br />Transit District.
