9.A -29 <br />Legislative Bill Action <br />................................ ............................... <br />wireless telephone or other driver distraction or <br />inattention is a known or suspected associated <br />factor to the cause of the collision. AB 1737 re- <br />quires the report to specify whether the telephone <br />was being used in a hand -held or hands -free mode <br />at the time of the traffic collision, if the traffic colli- <br />sion report concludes that a wireless telephone was <br />a known or suspected associated factor to the <br />cause of the traffic collision. SB 134 requires the owner of a <br />private work of improvement to notify, by registered <br />or certified mail, the original contractor, and any <br />claimant who has provided a preliminary 20 -day <br />notice prior to the recording of a mechanic's lien or <br />stop notice, that a notice of completion or notice of <br />cessation has been recorded within 10 days of <br />recordation of that notice of completion or notice of <br />cessation. SB 134 provides that failure to give <br />notice shall extend the period of time in which the <br />contractor or claimant may file a mechanic's lien or <br />stop notice to 90 days and provides that this exten- <br />sion would be the sole liability incurred for failure to <br />give notice. SB 134 defines "owner" as a person <br />who has an interest in real property, or the person's <br />successor in interest on the date a notice of cessa- <br />tion from labor is filed for record, who causes a <br />building, improvement, or structure, to be con- <br />structed, altered, or repaired on the property. Public Contracts. Consulting <br />Services. SB 839 revises the State Contract Act to <br />also prohibit a person, firm, or subsidiary thereof <br />that has been awarded a consulting services <br />contract from being financially interested in the <br />provision of services, the procurement of goods or <br />supplies, or any other related action that is re- <br />quired, suggested, or otherwise deemed appropri- <br />ate in the end product of the consulting services <br />contract. SB 839 specifies that a willful violation of <br />the existing prohibition against submitting a bid or <br />being awarded a contract, or the additional prohibi- <br />tion against being financially interested, is punish- <br />able by a fine of not more than $1,000 and impris- <br />onment in the county jail not exceeding one year or <br />by imprisonment in the state prison. SB 974 <br />requires the state to award at least a 5% prefer- <br />ence, and authorizes a local agency to award a <br />preference of at least 5 %, but not more than 10 %, <br />to a California -based socially responsible business <br />that certifies under penalty of perjury that it meets <br />at least 10 of 13 criteria. SB 974 makes legislative <br />declarations that promoting socially responsible <br />businesses serves a public purpose, and intends to <br />promote those businesses that honor, respect, and <br />safeguard human health and safety, worker dignity, <br />environmental sustainability, and the community in <br />which the businesses operate, by facilitating the <br />participation of those businesses in all public <br />contracts. SB 974 applies sanctions to a business <br />that obtains a contract pursuant to a preference <br />obtained by means of a false certification. As a matter <br />of existing policy, the League supports legislation <br />which would improve the housing element review <br />process. The state review process currently lacks <br />clarity in a number of areas, including the definition <br />"housing unit." AB 218 would direct the Department <br />of Housing and Community Development to adopt <br />the definition of "housing unit" and "unit" that are <br />outlined in the 2000 United States Census for the <br />purposes of applying housing element law. AS 218 <br />recently passed the Assembly Local Government <br />Committee, 8 -0.
