ORIGINAL <br /> <br /> AMENDMENT NO. 2 <br /> TO EMPLOYMENT AGREEMENT <br /> <br /> [Stan T. Yamamoto, City Attorney] <br /> <br /> THIS AMENDMENT NO. 2 is entered into and effective as of the 2nd day of <br />December, 2002, amending the Agreement dated July 30, 2001 (the "Agreement"), and <br />as amended by the Amendment No. 1, dated August 26, 2002 (Amendment No.1") by <br />and between the City of Redwood City, a charter city and municipal corporation ("City"), <br />and Stan T. Yamamoto ("Employee") (collectively, the "Parties") for City Attorney <br />services <br /> <br /> RECITALS <br /> <br /> A. The parties desire to amend and restate the Agreement to adjust the <br />base salary of the City Attorney and restate the rate of accrual of vacation leave. <br /> <br /> B. The Parties have negotiated and agreed to the following amendments: <br /> <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br />contained herein, City and Employee agree as follows: <br /> <br /> 1. Section 2 of the Agreement is amended in its entirety to read as follows: <br /> <br /> a. Employee shall be paid $157,500 per year, retroactive to the <br /> pay period beginning on July 29, 2002, payable in installments at the <br /> same time other City management employees are paid. The City Council <br /> may evaluate Employee's performance and may adjust Employee's <br /> annual salary and benefits based upon that performance evaluation. The <br /> City Council shall provide Employee with its comments, if any, and may <br /> discuss its evaluation with him, at the choice of either the City Council or <br /> Employee. Employee acknowledges and agrees that the City and the <br /> Redwood City Port Department ("Port") have made or will make <br /> independent arrangements for the Port to pay the City for any services <br /> Employee or the City Attorney Department may provide to the Port. <br /> <br /> 2. The Third sentence of Section 3.A. of the Agreement is amended to read <br /> as follows: <br /> <br />F:Atty/AgdAmend2.Salary Survey 1 <br />112102 <br /> <br /> <br />
