Exhibit A <br /> A. PURPOSE <br /> The JGC is collaborating with SPHERE on the development of the Youth Data Archive (YDA), an archive <br /> of matched longitudinal administrative data for conducting policy analyses for San Mateo County leaders <br /> and practitioners. Policy questions to be addressed using the YDA will be developed in collaboration with <br /> the City of Redwood City and representatives of local educational institutions, governmental agencies, <br /> and youth- serving organizations which contribute data to the YDA. To ensure that the YDA is a valuable <br /> resource for all agencies contributing data, the project may also work with the City to identify one or more <br /> additional research questions that will be included in the project scope on behalf of the City. <br /> B. NATURE OF DATA <br /> To further the achievement of the above stated purpose, the City will at its discretion provide JGC and <br /> SPHERE with data extracts from the City data systems to include data elements required to answer <br /> research questions defined by the City alone or with City participants in the YDA. <br /> These data extracts will include historical information wherever possible. Additional data elements may be <br /> provided at the discretion of the City. <br /> Because the YDA will match individual student level data, these data are expected to contain confidential <br /> information, the disclosure of which is restricted by a provision of law. Some examples of "confidential <br /> information" include, but are not limited to, "personal information" about individuals as defined in <br /> California Civil Code Section 1798.3 of the Information Practices Act and "personal information" about <br /> students as defined by the Code of Federal Regulations CFR Title 34 Volume 1 Part 99.3. <br /> C. JGC and SPHERE RESPONSIBILITIES; <br /> JGC and SPHERE agree to the following confidentiality statements: <br /> 1. JGC and SPHERE acknowledge that these data are confidential data and proprietary to the City, <br /> and agree to protect such information from unauthorized disclosures and comply with all <br /> applicable confidentiality laws including but not limited to, the Health Insurance Portability and <br /> Accountability Act (HIPAA), the California Education Code and the Family Education Rights and <br /> Privacy Act (FERPA) as set forth in this agreement. JGC and SPHERE are responsible for <br /> complying with all District, Local, State and Federal confidentiality applicable laws and <br /> regulations. <br /> 2. JGC and SPHERE shall designate Margaret O'Brien-Strain, Senior Research Associate, The <br /> SPHERE Institute (or such other successor person designated by JGC and SPHERE in their <br /> discretion), as the person responsible for the security and confidentiality of the data and will notify <br /> the City immediately in writing of any change in designee. <br /> 3. JGC and SPHERE will use appropriate safeguards to prevent the use or disclosure of the <br /> information other than as provided by this data use Agreement. <br /> 4. JGC and SPHERE shall (a) instruct all staff with access to confidential information about the <br /> requirements for handling confidential information, (b) provide all staff with access to confidential <br /> information statements of organizational policies and procedures for the protection of human <br /> subjects and data confidentiality and (c) notify staff of the sanctions against unauthorized <br /> disclosure or use of confidential and private information. JGC and SPHERE will ensure that all <br /> staff and subcontractors to whom they provide the limited data sets obtained under this <br /> Agreement, agrees to the same restrictions and conditions that apply to JGC and SPHERE in this <br /> City Attorney Approved Version #05.22.01 <br /> 4 <br />
