5.1 -2 <br />Tree work for the project will be coordinated and performed by the City's tree maintenance <br />staff or contractor as resources are available. Root pruning or tree removal decisions are <br />determined on a case by case basis, with the first priority being to preserve trees. <br />Adequate space is necessary between the tree and new sidewalk to perform root pruning. <br />Staff is administering the program following performance measure criteria to not remove <br />more than 20% of the larger trees on a street or more than two trees in a row. <br />Staff encourages property owners to preserve trees by allowing the City to establish a <br />sidewalk maintenance easement on private property for the relocation of the sidewalk. <br />Failure to provide the easement may cause the site to be skipped to avoid tree removal. <br />The City will bypass permanent sidewalk repairs if the property owner does not want to <br />provide an easement in order to retain a tree. A temporary asphalt repair will be made to <br />alleviate the defect and reduce the risk at the site. <br />Property owners are also offered the opportunity to participate in cost shared repairs for <br />defects of less than one -inch and may pay 100% of the repair cost for replacement of <br />undamaged concrete. <br />Based on the low bid, if the contractor proves to work in an effective manner, staff will be <br />coming back to Council for a change order for additional work for approximately $140,000, <br />since the awarded bid is lower than the Engineer's Estimate by $132,000 and the budget is <br />available. <br />Alternatives <br />1) Award the contract to a higher bidder. Staff is confident the low bidder can <br />complete the project. <br />2) Re -bid the contract. Staff does not believe a better price will be received through <br />another bid. <br />Fiscal Impact <br />Funds have been approved in the FY 2002 -2003 Capital Improvement Program, Tree <br />Preservation and Sidewalk Repair funding in the amount of $1,000,000.
