TA -12 <br />Legislative Bill Action <br />................................ ............................... <br />59A2 (Torlakson). Local Government. Sales <br />Taxes. Trans & Smart Growth Planning. The <br />California Constitution conditions the imposition of a <br />special tax by a city, county, or special district upon <br />the approval of 2/3 of the voters of the city, county, or <br />special district voting on that tax, and prohibits these <br />entities from imposing an ad valorem tax on real <br />property or a transactions or sales tax on the sale of <br />real property. SCA 2 would authorize a county, a city <br />and county, a local transportation authority, or a <br />regional transportation agency, as defined, with the <br />approval of a majority of its voters voting on the <br />proposition, to impose a special tax for the privilege of <br />selling tangible personal property at retail that it is <br />otherwise authorized to impose, if the tax is imposed <br />exclusively to fund transportation projects and ser- <br />vices and smart growth planning, as defined. The <br />League has expressed serious concern with the <br />provision that would mandate in every county the <br />expenditure of 25 percent of the monies for smart <br />growth planning. Loans of Transportation Rev- <br />enues and Funds. SCA 7 extends constitutional <br />loan conditions on Article 19 funds to any state <br />account in order to avoid the laundering of such loan <br />funds through new accounts for condition -free loans. <br />SCA 7 captures interest on multi -year loans of Article <br />XIX transportation funds so that transportation funds <br />do not subsidize other state accounts and do not <br />suffer lost interest income, which would otherwise <br />have been credited to the transportation accounts. <br />Staff: Natasha Fooman, Status: AsApps, Position: <br />Support. <br />SJR 7 (Kamette). Highways. Trucking Size. This <br />resolution would protect the safety of motorists on <br />California highways and prevent further degradation <br />of the nation's taxpayer supported infrastructure <br />network. Heavier single trailer trucks and longer <br />combination vehicles would overstress bridges, <br />increase pavement damage and other damage to <br />associated infrastructure and increase danger to our <br />citizens. Department of Motor <br />Vehicle Records. Access By City Attorneys. AB <br />365 grants city attorneys phone access to certain <br />Department of Motor Vehicles (DMV) records. AB 365 <br />allows city attorneys who prosecute numerous crimes <br />relating to drunk driving vehicle forfeiture, and other <br />vehicle - related crimes the same access to DMV <br />records that district attorneys have. AB 365 passed <br />out of Assembly Appropriation 18 -5 on 4/30/03. Staff: <br />Natasha Fooman, Status: AsmFlr, Position: Sup- <br />port. <br />AB 77 (Chan). Vehicles. Exhaust Sys. Modifi- <br />cation. AB 377 prohibits the modification of the <br />exhaust system of a motor vehicle with a whistle -tip <br />and would prohibit a person from operating a motor <br />vehicle if that vehicle's exhaust system is in violation <br />of that modification prohibition. Additionally AB 377 <br />prohibits a person from engaging in the business of <br />installing a whistle -tip. AB 377 passed out of the <br />Assembly Appropriations Committee 24-0 on 4/30/03. <br />Staff: Natasha Fooman, Status: AsmFlr, Position: <br />Support. <br />AB 972 (Correa). False Claims Act. AB 972 would <br />authorize a local government entity to file a civil action <br />under the False Claims Act only if it concludes, as a <br />result of its investigation, that there is a reasonable, <br />good faith belief that a violation of the Act has oc- <br />curred or is occurring, and that filing the action would <br />not be in retaliation for a contractors good faith <br />dispute regarding change orders, payment, or other <br />contractor terns. AB 972 is similar to SB 934 <br />(Margett) 2001 which the League opposed. The <br />author's office has made AS 972 a 2 year bill. AB 872 as amended, <br />allows a local authority, when conducting an engineer- <br />ing and traffic survey for the purpose of establishing a <br />speed limit on an urban, divided, and restricted <br />access arterial highway, to consider residential <br />density, under certain conditions, and pedestrian and <br />bicyclist safety.
