7A <br />Legislative Bill Action <br />am <br />housing development, or seek to overturn a local <br />decision to deny a project, by taking the matter to a <br />developer - friendly panel at the Department of Hous- <br />ing to overturn the local decision. The panel would <br />be composed of five political appointees who lack any <br />direct political accountability in the community where <br />the project is proposed. The political appointees are <br />empowered to order approvals at the local level, and <br />for the developer or panel to enforce these decisions <br />in court. There is no provision in the bill for local <br />appeal to a judicial body. This is one of the worst <br />anti -local control land use bills of the year. Staff: Dan Carrigg, Status: <br />SenApps, Position: Oppose. <br />SB 20 would respond to the Governor's veto mes- <br />sage last year on SB 1523 in which he called for new <br />legislation that would enact a manufacturer responsi- <br />bility program for electronic waste. <br />The League is working with the author's office and <br />other interested stakeholders to craft a program that <br />is workable at the local level and responds to the <br />needs of cities. The recently amended version of 5BB <br />20 is now available on the web and the bill will be <br />heard in the Senate Environmental Quality Committee <br />Monday May 12. Urban Landfills. <br />The League has removed its opposition to SB 983 It <br />no longer preempts local land use authority regarding <br />the siting and approval of urban landfills. Instead, it <br />would simply clarify existing law relative what informa- <br />tion siting elements must contain. It also would direct <br />the Secretary of Environmental Protection to submit a <br />report on the implementation of the Califomia Envi- <br />ronmental Justice by March 1, 2004, which is one <br />year earlier than is required under current law. SB 2 0 would <br />establish a manufacturer responsibility program for <br />the collection and recycling of electronic waste. It <br />would prohibit any person from selling certain elec- <br />tronic devices, designated as hazardous, in California <br />unless they meet one of two conditions. (1) The <br />company must develop and implement a plan that is <br />certified by the California Integrated Waste Manage- <br />ment Board for the collection, handling, transporta- <br />tion, processing, recover, reuse and recycling of <br />hazardous electronic waste resulting from that manu- <br />facturer. Or, (2) the company must pay a fee if it does <br />not submit a recovery plan that is certified by the <br />board. Funds from this fee would be used for grants <br />to local governments and nonprofit organizations for <br />recycling such products and for incentive payments to <br />manufacturers. <br />AB 140 (Levine). Vehicles. Peace Officers. <br />Fleeing. (Amended 4- 29 -03) AB 140 increases <br />penalties for intentionally attempting to evade a <br />peace officer and causing either serious bodily injury <br />or death of another person. (Amended 4- 22 -03) <br />Existing law imposes fines and terms of confinement <br />in the county jail for driving with a suspended or <br />revoked license, for driving with a license that was <br />suspended or revoked for a violation of certain <br />driving- under - the - influence (DUI) provisions, and for <br />driving in violation of restrictions imposed upon the <br />license for a violation of the DUI provisions. <br />A 486 increases the penalties for driving with a <br />suspended license for a person previously convicted <br />of reckless driving, driving under the influence, or <br />denied a driver's license due to negligence.
