3. Performance of Services. Within two (2) calendar days of written <br />notice to proceed given to Consultant by City, Consultant shall commence and <br />diligently pursue performances of Services hereunder. <br /> <br /> 4. Completion of Services. All work, including sampling and test results <br />described in this Agreement shall be completed by December 31, 1998. <br /> <br /> 5. Termination Date. This Agreement shall terminate on December 31, <br />1998, unless extended in writing by the parties, and evidenced by motion duly <br />made and carried by the City Council of the City of Redwood City. <br /> <br /> 6. Direction; Supervision; Conformance. All of the Services shall be <br />done under the direction and supervision of, and to the approval of, City or its <br />authorized representative, and the work shall be done in a professional and <br />workmanlike manner, conforming strictly to the provisions of this Agreement, and <br />the Plan and implementing documents approved by City and the California <br />Regional Water Quality Control Board ("RWQCB") in connection therewith. <br /> <br /> 7. Workers' Compensation Insurance, In accordance with the <br />provisions of Article 5, Chapter 1, Part 7, Division 2 (commencing with Section <br />1860), and Chapter 4, Part 1, Division 4 (commencing with Section 3700) of the <br />California Labor Code, Consultant is required to secure the payment of <br />compensation to its employees and for that purpose obtain and keep in effect <br />adequate Workers' Compensation insurance. If Consultant, in the sole <br />discretion of City, satisfies City of the responsibility and capacity under the <br />applicable Workers' Compensation laws, if any, to act as self-insurer, it may so <br /> <br />AGMT-'I~ 3 <br />~hared/~har ed/R edwood~c~n~il <br />FXS:rg <br /> <br /> <br />
