Public Works Contracts. <br />Compensation of Contractors. AB 453 seeks to <br />change California statutory and case law that have <br />been in place for at least a century. The current law <br />can be harsh at times, but it has served both the <br />state and local agencies very well over the decades. <br />AB 453 passed out of the Assembly Appropriations <br />Committee on May 13, and the League urges that <br />letters be sent in opposition to this bill. It provides <br />that if a contract with a public agency is declared <br />void, then no payments can be made under it. <br />Competitive bidding laws exist to benefit and enrich- <br />ment of bidders. AB 453 is similar to AB 750 <br />(Brewer), which was vetoed by the Governor in <br />1998. Staff: Natasha Fooman; Status: AsmFlr, <br />Position: Oppose. <br />AB 559 (Harman). Vehicles. Residence <br />Addresses. Release to Private Parking Entities. <br />AB 559 authorizes the Department of Motor Vehicles <br />(DMV) to provide residence address information to a <br />city or county for the purpose of enabling the city or <br />county to provide that information to a private entity <br />that has been issued a license or a permit by the city <br />or county, or has entered into a memorandum of <br />understanding with the city or county, authorizing the <br />private entity to enforce parking laws. AB 559 <br />prohibits the department from releasing a residence <br />address to a city or county under these provisions <br />until the department has entered into a contract with <br />the private entity. AB 559 specifies that the current <br />attorney authorization to access confidential informa- <br />tion in the DMV files does not apply to those attor- <br />neys acting on behalf of a private parking facility <br />owner. AB 559 is also similar to last year's SB 2031 <br />(Kamette), a measure that was held on this <br />committee's Suspense File. Staff: Natasha <br />Fooman; Status: AsApps- Suspense File, Position: <br />Review and Comment. <br />ACA 7 (Dutra). Transportation Funding. <br />Sales and Use Tax. ACA 7 authorizes a local <br />transportation agency and a regional transportation <br />agency to impose an additional sales and use tax for <br />a period of 20 to 30 years, as specified, at a rate of <br />0.5% exclusively for transportation purposes within <br />the jurisdiction of the local or regional transportation <br />agency if the additional tax is approved by 55% of the <br />voters of the jurisdiction voting on the proposition to <br />impose the tax. Additionally, ACA 7 requires the <br />revenues derived from these taxes to be deposited in <br />the Local Transportation Infrastructure Account to be <br />used for specified transportation purposes. This bill <br />passed out of the Assembly Transportation Commit- <br />tee on May 13 by a vote of 13 -5. Trucking Size. <br />SJR 7 requires the President and Congress to <br />maintain truck safety requirements during the <br />reauthorization of the Transportation Equity Act for <br />the 21" Century (TEA 21). This resolution would <br />protect the safety of motorists on California high- <br />ways and prevent further degradation of the nation's <br />taxpayer supported infrastructure network.
