SJR 7 <br />Passed out of Senate Transportation by a vote of 9 -2 <br />on May 6. Staff: Natasha Fooman, Status: SenFIr, <br />Position: Support. <br />ADMINISTRATIVE <br />AB 71 (Horton). Tobacco. Retailer Licensing. <br />The illegal sale of tobacco products results in a <br />significant loss of sales tax revenue for the state, as <br />well as for cities. AB 71 establishes a statewide <br />system for licensing of tobacco retailers by enacting <br />the Cigarette and Tobacco Products Licensing Act <br />of 2003. It would impose licensing requirements on <br />tobacco manufacturers, wholesalers, retailers and <br />importers. AB 71 would not preempt existing or new <br />local ordinances that also provide for licensing of <br />tobacco retailers, with the exception of imposition <br />and collection of state taxes. The League supports <br />AB 71 because it is appropriate and important to <br />ensure that retailers are selling tobacco legally and to <br />stem the trend in sales of illegal tobacco products. <br />Revenue for Propositions 99 and 10 is also impacted <br />when illegal tobacco products are sold. Staff: <br />Yvonne Hunter, Status: AsRev &Tax - Suspense File, <br />Position: Support. <br />ENVIRONMENTAL <br />SB 196 (Kuehl). Regional Water Quality <br />Control Boards. Municipal Members. SB 196 is <br />a League- sponsored bill that clarifies existing law <br />regarding the composition of the state's nine regional <br />water quality control boards. Existing law provides <br />that each regional board shall include one member <br />who is "associated with a municipal government." <br />SB 196 would provide clarification that the individual <br />appointed to this position is a mayor or a city council <br />member. Currently, of the nine regional boards, only <br />three include mayors or council members in the <br />"associated with municipal government" position. <br />This clarification would only apply at the next and <br />subsequent vacancies for this position. See the April <br />11 and May 2 editions of Priority Focus (PF #14 & <br />.. ............................... <br />#17) for additional information on SB 196. This week, <br />SB 196 was approved - 9 -0 on the Senate floor. <br />Staff: Yvonne Hunter, Status: AsEnvSafe &ToxMat, <br />Position: Support/Sponsor. <br />SB 20 (Sher). Electronic Waste. SB 20 <br />establishes a manufacturer responsibility program <br />for the collection and recycling of electronic waste. <br />The bill prohibits any person from selling certain <br />electronic devices, designated as hazardous, in <br />California unless they either develop and implement <br />a program to provide convenient recycling opportuni- <br />ties for their products, or they could pay a fee in lieu <br />of such a program to be used to support grants to <br />local governments. The bill also includes provisions <br />that protect California manufacturers from out of <br />state computer manufacturers who avoid complying <br />with the provisions of SB 20. The Senate Environ- <br />mental Quality Committee approved SB 20 on May <br />12. Staff: Yvonne Hunter; Status: SenApps; Hrg -5/ <br />19, Position: Support. <br />AB 897 (Jackson). Water Quality. Enforce- <br />ment. AB 897 makes a number of significant <br />changes to existing law regarding enforcement of <br />water quality statutes and regulations. Some of the <br />changes are beneficial to local government and <br />some are extremely troublesome. However, after a <br />productive meeting between the League, CSAC, the <br />California Association of Sanitation Agencies, the <br />author's staff and representatives of the State Water <br />Resources Control Board, it appears that the local <br />government associations' objections to the bill can <br />be resolved. In particular, resolution to the "bounty <br />hunter', 90-day Basin Plan appeal and criminal <br />penalty provisions were discussed and alternative <br />language conceptually agreed upon. The League, <br />CSAC and CASA are hopeful that the amendments <br />will enable us to remove our opposition.
