• . • <br /> SECTION 3. Section 23.6 is hereby added to the aforementioned <br /> Ordinance No. 600 to read as follows: <br /> "SECTION 23.6. Successive Petitions. No petition for an <br /> amendment to change the boundaries of any district shall be <br /> considered within one (1) year after fins1 action taken on a <br /> previous such petition relating to the same subject matter. <br /> "Petitions shall be deemed to relate to the same subject <br /> matter if both of the following factors exist: (a) any por- <br /> tion of the parcel of land affected by the former petition is <br /> to be included in the later petition and (b) the nature of the <br /> change to be petitioned for is substantially similar to the <br /> change petitioned for in the former petition. <br /> "The date of final action shall be the date upon which <br /> the City Council acted to adopt or deny the proposed amend- <br /> ment as provided in Section 23.5. <br /> "Determinations of what constitutes the same subject <br /> matter and of what date is the date of final action shall be <br /> made by the Planning Director and shall be reviewed by the <br /> Planning Commission if written request is made by the appli- <br /> cant within five (5) days of the Planning Director's deter- <br /> mination. On review, all decisions of the Planning Commission <br /> shall be final. <br /> "The foregoing shall not be construed as a limitation on <br /> proceedings initiated by resolutions of intention." <br /> SECTION 4. This ordinance shall be effective thirty (30) <br /> days after its adoption. <br /> -3- <br /> EXHIBIT "A" <br />
