4 • <br /> "Determinations of what constitutes the same subject <br /> matter and of what date is the date of final action shall be <br /> 'made by the Planning Director and shall be reviewed by the <br /> Planning Commission if written request is made by the appli- <br /> cant within five (5) days of the Planning Director's deter- <br /> mination. On review, all decisions of the Planning Commission <br /> shall be final." <br /> SECTION 2. Section 21.8 is hereby added to the aforementioned <br /> Ordinance No. 600 to read as follows: <br /> "SECTION 21.8. Successive Applications. No application <br /> for a use permit, revocable use permit or use permit valid <br /> for a fixed period shall be considered within one (1) year <br /> after final action taken in connection with the denial of a <br /> previous application relating to the same subject matter. <br /> "Applications shall be deemed to relate to the same sub - <br /> ject matter if both of the following factors exist: (a) any <br /> portion of the parcel of land affected by the former applica- <br /> tion is to be included in the later application and (b) the <br /> nature of the permit to be applied for is substantially sim- <br /> ilar to the variance applied for in the former application. <br /> "The date of final action shall be the date upon which <br /> the denial of the former application was determined on appeal <br /> or the expiration of the time in which an appeal from a denial <br /> could have been filed. <br /> "Determinations of what constitutes the same subject <br /> matter and of what date is the date of final action shall be <br /> made by the Planning Director and shall be reviewed by the <br /> Planning Commission if written request is made by the appli- <br /> cant within five (5) days of the Planning Director's deter- <br /> mination.
