4 • "Determinations of what constitutes the same subject matter and of what date is the date of final action shall be 'made by the Planning Director and shall be reviewed by the Planning Commission if written request is made by the appli- cant within five (5) days of the Planning Director's deter- mination. On review, all decisions of the Planning Commission shall be final." SECTION 2. Section 21.8 is hereby added to the aforementioned Ordinance No. 600 to read as follows: "SECTION 21.8. Successive Applications. No application for a use permit, revocable use permit or use permit valid for a fixed period shall be considered within one (1) year after final action taken in connection with the denial of a previous application relating to the same subject matter. "Applications shall be deemed to relate to the same sub - ject matter if both of the following factors exist: (a) any portion of the parcel of land affected by the former applica- tion is to be included in the later application and (b) the nature of the permit to be applied for is substantially sim- ilar to the variance applied for in the former application. "The date of final action shall be the date upon which the denial of the former application was determined on appeal or the expiration of the time in which an appeal from a denial could have been filed.
