• <br /> . <br /> • <br /> generally outlined in this agreement, and said subdivision map, <br /> plans and specifications referred to in this paragraph are hereby <br /> incorporated herein and made a part of this agreement by reference <br /> thereto. <br /> 13. Subdividers agree that if within a period of one year <br /> after final acceptance of the work done under this agreement any <br /> structure or part of any structure furnished and/or installed or <br /> constructed or caused to be constructed by Subdividers, or any of <br /> the work dose under this agreement, fails to fulfill any of the <br /> requirements of this agreement or the specifications referred to <br /> herein, subdividers will without delay and without any cost to the <br /> City, repair or replace or reconstruct any defective or otherwise <br /> unsatisfactory part or parts of the work or structure. should Sub.- <br /> dividers fail to act promptly or in accordance with this require- - <br /> wont, or should the exigencies of the case require repairs or <br /> replacements to be made before the Subdividers can be notified, <br /> the City may at its option, make the necessary repairs or replace' <br /> ments or perform the necessary work and the Subdividers shall pay <br /> to the City the actual cost of such repairs plus fifteen (15) <br /> percent. <br /> 13. It is mutually understood and agreed that neither Sub- <br /> dividers nor any of their agents or contractors are or shall be <br /> considered to be agents of the City of Redwood City in connection <br /> with the performance of Subdividers' obligations under this agreement. <br /> 14. Subdividers shall pay to City the actual cost to City <br /> for all engineering, inspection, and other services furnished <br /> by City in connection with this subdivision. City shall furnish <br /> monthly statements of all charges for services performed by City <br /> and Subdividers shall complete payment of such charges within <br /> ..7.Y <br />
