8.A
Page 27
Cade Comp(iance
it was determined that the revised submittal conforms to the provisins of the R-1 Zoning
District regarding building setbacks, height limitations, and lot coverage. Below is a table that
depicts the proposed and required zoning requirements per Article 5 and Artic)e 30 of the
Zoning Ordinance:
Existing Proposed Zoning
Requirements
Front
Seiback 21ft 6in 20ft 6in min 20 ft.'
Side
Setbacks 11ft & 16ft 5ft min 5ft."
Rear
Setbacks A rox.30ft 20ft min 20 ft.
Hei ht 22 ft. 3in 24ft max 28 ft.
min 2 covered
Parkin 0 2 s aces
Lot Covera e 16.9% 39.7% max a0 %
" Minimum 20 feet setback to garage, 15 foot setback to residence
•* For lots less than 60 feet in width, side setback is 10% of lot width, but not less than 4 feet
As previously stated, the applicant has asked to remove ihe Italian Stone Pine (Pinus pinea).
Because the tree meets the criteria of a protected iree per the City's tree preservation ordinance
(i.e. all trees growing on private property with trunk sizes that exceed 38 inches in
circumference [twelve inches in diameter] measured between six inches and 36 inches above
ground), the applicant was asked to provide an arborist report, inclusive of a valuation of the
tree, a tree protection plan, and a professional recommendation.
On Augusi 27, 2010, the City received a copy of the "Valuation and Tree Protection Plan" from
Walter Levison, Consultig Arborist for the property at 448 Saint Francis Street. According to
this report, the Italian Stone Pine measured 21 inches in diameter at 4 feet 6 inches above
grade.
The summary section of the report provides some additional specifics regarding the Italian
Stone Pine, most notably:
The tree exhibits two co-dominant mainstems, one vertical over 448 Saint
Francis, and one with a severe lean approximatefy 45 degrees off vertical, which
extends out over the neighbor's driveway... The overall condition rating was •
sign'rficantly downgraded due to the structural issue of the co-dominant mainstem
lean. 45 degrees is the threshofd angle for removal of a tree (Smiley, Bartlett
Tree Research Lab). In this case, since we have one vertical and one leaning
stem, the leaner would be removed if the tree were to be preserved. The tree
does require removal, since the tension side (448 St. Francis side} of the root
system will be destroyed during foundation footing excavation for the proposed
site plan... If this tree was to be retained in a non-development type situation, I
would remove the entire leaning stem at the fork/crotch at 6 feet above grade.
Note that in terms of tree risk, this specimen currently has an "elevated risk of
failure".
