i _
8.A
Page 70
same tree. The Zonin Administrator's decision was based on consideration of
9
Architectural Standard E(the extent to which natural features are to be retained),
evaluation of existing streetscape, the professional recommendation of a Certified
Arborist (Attachment 14) and the concurrence of the City's Urban Forestry Specialist.
The appellants were provided the opportunity to submit additional Arborist Report(s) for
consideration by staff during the review process, but did not do so, and the Zoning
Administrator rendered a decision on the information available in the administrative
record.
Conclusions ofFact and Law thatApellants would have Demonstrated: Dcstroying this is not
necessary, for Mr. Carroll to construct his house, even as is, and is a violation of Standard E, in
that the Planning Department ignored these options, and to apply the guidelincs
appropriately.
a. Appellant.s would have demonstrated that between SO% - 60% of the crown of the
Tree is on Appellants ' property, and that the renroval of the Tree would hme caused
Appellant.s a financial loss amounting to tens of thorsand.s of dollars.
Staff Response: The applicant is retaining existing mature trees on the subject
property that are not in direct conflict with the location of the proposed residence.
Furthermore, the design of the proposed residence is in harmony with the natural grade
of the site. Consequently, based on the analysis provided in the Notice of Official Action
(Attachment 3), the Zoning Administrator made the determination that the proposed
application is consistent with the Redwood City Zoning Ordinance, based on
Architectural Standard E.
As to the appellants' statement in subsection a., above, the Italian Stone Pine is located
entirely on the applicant's property, as can be referenced on the site plans provided in
Attachment 1, and only leans onto the appellants' property. Neither the 50%-60%
crown issue nor the financial loss assertion falls within the scope of the Zoning
Administrator's consideration of Architectural Standard E(the extent to which natural
features are to be retained) or the Redwood City Zoning Ordinance.
2. Appellant.c wnuld have identired one or more reul estate appraisers with the relevant
ea.pertise who would have estublished that removing the, fully mature Italian Stone Pine would
reduce the property values uf at least four adjoining or nearby properties.
Staff Response: Consideration has been given to the loss of the Italian Stone Pine. As
such, the Zoning Administrator included conditions in the Notice of Ocial Action
requiring replacement planting. Conditions 8 and 9 state:
8. Pior to the removal of the Italian Stone Pine, the applicant shall submit a
replacement planting plan for the City's review and approval.
9. The Italian Stone Pine shafl be replaced by a new tree(s) equal to the amount
of $3,190 as established in the Valuation and Tree Protection Plan. The
2
