THIS AGREEMENT, made and entered into this 7 day <br /> of -.. ., ,; //, ,0 1959, by and between PACIFIC GAS AND <br /> EIi TRIC COMPANY, a corporation, hereinafter called "Pacific", <br /> and the CITY OP` REDWOOD C1"P' " a municipal corporation, hereinafter <br /> called "City ", <br /> WITNESSET H: <br /> WHEREAS, Pacific maintains gas and electric facilities <br /> upon an easement and right of way acquired by Pacific from <br /> Leonard N. Holt an September 27, 1927; and <br /> WHEREAS City has requested Pacific to relocate said <br /> gas and electric facilities to accommodate contemplated public <br /> work in, under and around Pacific's said easements and rights of <br /> way; and <br /> WAS, said relocation poses issues of law and fact now <br /> in dispute between the several parties hereto, particularly as to <br /> whether Pacific 18 entitled to compensation or reimbursement for <br /> Ito costs of relocating said facilities to a location where they <br /> will not interfere with City's said use of said property; and <br /> WCEA,S, Pacific is willing to undertake the relocation <br /> cork provided Pacific is fully protected in all of its legal rights <br /> in respect to compensation or reimbursement from City i'or the cost <br /> of such work. <br /> NOW. THEREFORE, in consideration of the promises and <br /> mutual terms, covenants and provisions hereinafter contained, it <br /> is agreed by and between the parties hereto: <br /> 1.
