_' '� • <br /> R E S O L U T I ON N 0. 2871 (adopted 9/14/59) <br /> RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND <br /> NECESSITY REQUIRE THE ACQUISITION BY THE CITY OF <br /> REDWOOD CITY OF CERTAIN RIGHTS IN AND UPON LOT 21, <br /> BLOCK 7, HIGHLANDS OF EMERALD LAKE SUBDIVISION NO. ONE, <br /> IN CONNECTION WITH CERTAIN PUBLIC IMPROVEMENTS AID AU- <br /> THORIZING THE CITY ATTORNEY TO BRING AN ACTION IN <br /> EMINENT DOMAIN TO ACQJIRE SAID INTERESTS <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> AS FOLLOWS: <br /> That it hereby finds and determines and declares: <br /> That the public interest and necessity require the construc- <br /> tion by the City of Redwood City of a public improvement, namely <br /> a public street, adjacent to certain real property hereinafter <br /> described; <br /> That the acquisition by the City of Redwood City of an <br /> easement of ingress and egress in and upon that certain real <br /> property hereinafter described is necessary for said public <br /> improvement; <br /> That said public improvement is a public use authorized by <br /> law and that the said public improvement is the basis for the <br /> acquisition of the rights of ingress and egress to the herein- <br /> after described property; <br /> That said public improvement is planned and located in the <br /> manner which will be most compatible with the greatest public <br /> good and the least private injury; <br /> AND, BE IT FURTHER RESOLVED: <br /> That the City of Redwood City acquire said rights in and upon <br /> said real property, for said public improvement, by an action in <br /> eminent domain in accordance with the provisions of the Charter <br /> of the City of Redwood City, the provisions of Article I, Sec- <br /> tion 14, of the L'onstitution of the State of California, and the <br /> provisions of the Code of Civil Procedure of the State of <br />
