There is excepted from said District all streets and other <br /> public property in use in the performance of a public function. <br /> 4. Notice is hereby given that serial bonds to represent un- <br /> paid assessments and bearing interest at the rate of not to exceed <br /> six per cent (6%) per annum will be issued hereunder in the manner <br /> provided by Division 7, Part 5, of the Streets and Highways Code of the <br /> State of California (Improvement Act of 1911 Type), and the last install- <br /> ment of such bonds shall mature fourteen (14) years from the 2nd day of <br /> January next succeeding the next October 15th following their date. <br /> Said bonds shall be payable to bearer. <br /> 5. Notice is hereby given that MONDAY, the 28th DAY OF <br /> SEPTEMBER, 1959, at the hour of eight o'clock P.M., at the Council <br /> Chamber in the Hall of Justice and Records in the City of Redwood City, <br /> California, is hereby fixed as the time and place when and where any <br /> and all persons interested may appear and show cause, if any they have, <br /> why the City Council should not find and determine that the public con- <br /> venience and necessity require the acquisitions and improvements described <br /> and referred to in this resolution, without further compliance with the <br /> Special Assessment, Investigation, Limitation and Majority Protest Act <br /> of 1931. <br /> 6. Said Council does hereby adopt and establish as the official <br /> grades for said work the grades and elevations to be shown upon such <br /> plans, profiles and detailed drawings. <br /> 7. There is to be excepted from the work above described any of <br /> such work already done to line and grade and marked accepted or shown <br /> not to be done on said plans, profiles and detailed drawings. <br /> 8. Except as herein otherwise provided for the issuance of bonds, <br /> all of said proceedings will be had pursuant to Article II -A of Ordin- <br /> ance No. 333 of the City of Redwood City, entitled "Redwood City Improve- <br /> ment Procedure Ordinance ", as amended, and Ordinance No. 515 of said <br /> City, as amended. <br /> 9. The Clerk of Redwood City shall give notice of the adoption <br /> of this resolution by publishing a Notice of Proposed Local Improvement <br /> once in the Redwood City Tribune, a daily newspaper published, printed <br /> and circulated in said City, and by posting same on or near the Council <br /> Chamber door of said Council, said posting and publication to be com- <br /> pleted at least ten (10) days prior to the date of said hearing. <br /> 10. If any surplus shall remain in the improvement fund contem- <br /> plated herein after the improvement is completed, such surplus shall be <br /> refunded or credited pro -rata in the manner provided in Subsections (a) <br /> and (b) of Section 10,427 of the Streets and Highways Code of the State <br /> of California. <br /> * * * * * * * <br /> -3- <br />
