There is excepted from said District all streets and other public property in use in the performance of a public function. 4. Notice is hereby given that serial bonds to represent un- paid assessments and bearing interest at the rate of not to exceed six per cent (6%) per annum will be issued hereunder in the manner provided by Division 7, Part 5, of the Streets and Highways Code of the State of California (Improvement Act of 1911 Type), and the last install- ment of such bonds shall mature fourteen (14) years from the 2nd day of January next succeeding the next October 15th following their date. Said bonds shall be payable to bearer. 5. Notice is hereby given that MONDAY, the 28th DAY OF SEPTEMBER, 1959, at the hour of eight o'clock P.M., at the Council Chamber in the Hall of Justice and Records in the City of Redwood City, California, is hereby fixed as the time and place when and where any and all persons interested may appear and show cause, if any they have, why the City Council should not find and determine that the public con- venience and necessity require the acquisitions and improvements described and referred to in this resolution, without further compliance with the Special Assessment, Investigation, Limitation and Majority Protest Act of 1931. 6. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon such plans, profiles and detailed drawings. 7. There is to be excepted from the work above described any of such work already done to line and grade and marked accepted or shown not to be done on said plans, profiles and detailed drawings. 8. Except as herein otherwise provided for the issuance of bonds, all of said proceedings will be had pursuant to Article II -A of Ordin- ance No. 333 of the City of Redwood City, entitled "Redwood City Improve- ment Procedure Ordinance ", as amended, and Ordinance No. 515 of said City, as amended. 9. The Clerk of Redwood City shall give notice of the adoption of this resolution by publishing a Notice of Proposed Local Improvement once in the Redwood City Tribune, a daily newspaper published, printed and circulated in said City, and by posting same on or near the Council Chamber door of said Council, said posting and publication to be com- pleted at least ten (10) days prior to the date of said hearing. 10. If any surplus shall remain in the improvement fund contem- plated herein after the improvement is completed, such surplus shall be refunded or credited pro -rata in the manner provided in Subsections (a) and (b) of Section 10,427 of the Streets and Highways Code of the State of California. * * * * * * * -3-
