• • <br /> 3999 Contractor shall furnish renewal certificates to Agency to demonstrate maintenance <br /> 4000 of the required coverages throughout the Term. <br /> 4001 F. Other Insurance Requirements <br /> 4002 1. In the event performance of any services is delegated to a Subcontractor, <br /> 4003 Contractor shall require such subcontractor to provide statutory workers' <br /> 4004 compensation insurance and employer's liability insurance for all of the <br /> 4005 Subcontractor's employees engaged in the work. The liability insurance <br /> 4006 required by Subsection A.2 and the automobile liability policy required by <br /> 4007 subsection A.3 shall cover all Subcontractors or the Subcontractor must furnish <br /> 4008 evidence of insurance provided by it meeting all of the requirements of this <br /> 4009 Section 13.02. <br /> 4010 2. Contractor shall comply with all requirements of the insurers issuing policies. <br /> 4011 The carrying of insurance shall not relieve Contractor from any obligation under <br /> 4012 this Agreement, including those imposed by Section 13.01. If any claim is <br /> 4013 made by any third Person against Contractor or any Subcontractor on account <br /> 4014 of any occurrence related to this Agreement, other than claims by employees <br /> 4015 for work - related incidents, Contractor shall promptly report the facts in writing to <br /> 4016 the insurance carrier and to the Agency. <br /> 4017 3. If Contractor fails to procure and maintain any insurance required by this <br /> 4018 Agreement, Agency may take out and maintain such insurance as it may deem <br /> 4019 proper and may require Contractor to reimburse it for the cost incurred within <br /> 4020 thirty (30) Days and /or deduct the cost from any monies due Contractor. <br /> 4021 Agency may also treat the failure as a Contractor default. <br /> 4022 4. Agency is not responsible for payment of premiums for or deductibles under <br /> 4023 any required insurance coverages. <br /> 4024 5. Any excess or umbrella policies shall be written on a "following form" basis. <br /> 4025 13.03 FAITHFUL PERFORMANCE BOND <br /> 4026 On or before the Effective Date, Contractor shall file with Agency a bond securing the <br /> 4027 Contractor's faithful performance of its obligations under this Agreement. The principal <br /> 4028 sum of the bond shall be no less than ten percent (10 %) of the amount of the 2011 <br /> 4029 annual Revenue Requirement for Agency shown on Attachment N. The form of the <br /> 4030 bond shall be as set out in Attachment F. The bond shall be executed as surety by a <br /> 4031 corporation admitted to issue surety bonds in the State of California, regulated by the <br /> 4032 California Insurance Commissioner, and with a financial condition and record of service <br /> 4033 satisfactory to Agency. <br /> 4034 The term of the bond shall be twenty -four (24) months. The bond shall be extended, or <br /> 4035 replaced by a new bond in the same principal sum (adjusted by the percentage change <br /> 4036 in the Consumer Price Index), for the same Term (i.e., twenty -four (24) months) and in <br /> 4037 the same form, bi- annually thereafter. Not less than ninety (90) Days before the <br /> 4038 expiration of the initial, or any subsequent, bond, Contractor shall furnish either a <br /> 4039 replacement bond or a continuation certificate substantially in the form attached as <br /> 4040 Attachment F, executed by the surety. <br /> 4041 It is the intention of this section that there be in full force and effect at all times a bond <br /> 4042 securing the Contractor's faithful performance of the Agreement, throughout its Term. <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 100 of 115 <br />
