• • <br /> 1 ATTACHMENT A <br /> 2 DEFINITIONS <br /> 3 Unless the context otherwise requires, capitalized terms used in this Agreement will have the <br /> 4 meanings specified in this Article. <br /> 5 Act <br /> 6 "Act" means the California Integrated Waste Management Act of 1989 (AB 939) Public <br /> 7 Resources Code, Section 40000 et seq. as currently in force or as hereafter amended. <br /> 8 Affiliate <br /> 9 "Affiliate" means a Person which is related to Contractor by virtue of direct or indirect ownership <br /> 10 interest or common management. An Affiliate includes a Person in which Contractor owns a <br /> 11 direct or indirect ownership interest, a Person which has a direct or indirect ownership interest in <br /> 12 Contractor and /or a Person which is also owned, controlled or managed by any Person or <br /> 13 individual which has a direct or indirect ownership interest in Contractor. <br /> 14 Agency <br /> 15 "Agency" means the City of Redwood City. <br /> 16 Agency Manager <br /> 17 "Agency Manager" means Agency's City Manager, as designated by Agency. <br /> 18 Agreement <br /> 19 "Agreement" means this Agreement, including the attachments. <br /> 20 Applicable Law <br /> 21 "Applicable Law" means all federal, State, and local laws, regulations, rules, orders, judgments, <br /> 22 decrees, permits, approvals, or other requirements of any governmental agency having <br /> 23 jurisdiction over the Collection, transportation, Processing, and Disposal of Solid Waste, <br /> 24 Targeted Recyclable Materials, Organic Materials and other materials Collected pursuant to this <br /> 25 Agreement that are in force on the Effective Date and as they may be enacted, issued or <br /> 26 amended during the Term. <br /> 27 Application <br /> 28 "Application" means the application prepared and submitted by Contractor for determination of <br /> 29 Contractor's Compensation for the following Rate Year. <br /> 30 Authority <br /> 31 "Authority" means the South Bayside Waste Management Authority or "SBWMA." <br /> 32 Average Hold Time <br /> 33 "Average Hold time" means the sum of all call Hold Times divided by the number of calls <br /> 34 answered by the agent or queue of agents over the same time interval. <br /> Franchise Agreement for Collection Services with Recology San Mateo County Attachment A <br /> City of Redwood City Definitions <br /> Page 1 of 17 <br />
