• • <br /> 226 Fiscal Year <br /> 227 "Fiscal Year" means the period commencing July 1s through June 30 each year. <br /> 228 Food Scraps <br /> 229 "Food Scraps" means a subset of Organic Materials including: (i) all kitchen and table food <br /> 230 waste, and animal, or vegetable fruit, grain, dairy or fish waste that attends or results from the <br /> 231 storage, preparation, cooking or handling of foodstuffs, with the exception of animal excrement, <br /> 232 (ii) paper waste contaminated with putrescible material, and (iii) biodegradable plastic food <br /> 233 service ware. <br /> 234 Franchise Fee <br /> 235 "Franchise Fee" means the fee paid by Contractor to Agency pursuant to Section 10.02. <br /> 236 Generator <br /> 237 "Generator" means any Person whose act or process produces Solid Waste, Targeted <br /> 238 Recyclable Materials, or Organic Materials, or whose act first causes Solid Waste to become <br /> 239 subject to regulation. <br /> 240 Gross Revenue Billed <br /> 241 "Gross Revenue Billed" means the total revenue recognized per generally accepted accounting <br /> 242 principles by the Contractor for all services provided to Customers during the Rate Year in <br /> 243 question. Revenues may be billed by the Contractor to Customers or may be billed by Agency <br /> 244 to Customers. <br /> 245 Guarantor <br /> 246 "Guarantor" means Recology Inc. <br /> 247 Guaranty <br /> 248 "Guaranty" means the agreement to be executed by the Guarantor in the form of Attachment G. <br /> 249 Hazardous Substance <br /> 250 "Hazardous Substance" shall mean any of the following: (a) any substances defined, regulated <br /> 251 or listed (directly or by reference) as "Hazardous Substances ", "hazardous materials ", <br /> 252 "Hazardous Wastes ", "toxic waste ", "pollutant" or "toxic substances" or similarly identified as <br /> 253 hazardous to human health or the environment, in or pursuant to (i) the Comprehensive <br /> 254 Environmental Response, Compensation and Liability Act of 1980, 42 USC §9601 et <br /> 255 seq.(CERCLA); (ii) the Hazardous Materials Transportation Act, 49 USC §1802, et seq.; (iii) the <br /> 256 Resource Conservation and Recovery Act, 42 USC §6901 et seq.; (iv) the Clean Water Act, 33 <br /> 257 USC §1251 et seq.; (v) California Health and Safety Code § §25115- 25117, 25249.8, 25281, <br /> 258 and 25316; (vi) the Clean Air Act, 42 USC §7901 et seq.; and (vii) California Water Code <br /> 259 §13050; (b) any amendments, rules or regulations promulgated there under to such enumerated <br /> 260 statutes or acts currently existing or hereafter enacted; and (c) any other hazardous or toxic <br /> 261 substance, material, chemical, waste or pollutant identified as hazardous or toxic or regulated <br /> 262 under any other applicable Federal, State or local Environmental Laws currently existing or <br /> 263 hereinafter enacted, including, without limitation, friable asbestos, polychlorinated biphenyl's <br /> 264 ( "PCBs "), petroleum, natural gas and synthetic fuel products, and by- products. <br /> Franchise Agreement for Collection Services with Recology San Mateo County Attachment A <br /> City of Redwood City Definitions <br /> Page 7 of 17 <br />
