<br /> 418 Pass - Through Cost
<br /> 419 "Pass- Through Cost" means a cost to which no element of overhead, administrative expense, or
<br /> 420 profit, is added, such that the specific amount of such cost is included without modification in the
<br /> 421 calculations or reports prepared in implementing this Agreement.
<br /> 422 Person
<br /> 423 "Person" means any individual, firm, company, association, organization, partnership,
<br /> 424 corporation, trust, joint venture, the United States, the State, the County, towns, cities, or special
<br /> 425 purpose districts.
<br /> 426 Plant Materials
<br /> 427 "Plant Materials" means a subset of Organic Materials consisting of grass cuttings, weeds,
<br /> 428 leaves, prunings, branches, dead plants, brush, tree trimmings, dead trees (not more than six
<br /> 429 (6) inches in diameter) and five (5) feet in length, and similar materials generated at Premises,
<br /> 430 separated and set out for Collection. Plant Materials does not include materials not normally
<br /> 431 produced from gardens or landscape areas, such as, brick, rock, gravel, large quantities of dirt,
<br /> 432 concrete, sod, non - organic wastes, oil, and painted or treated wood products. Diseased plants
<br /> 433 and trees may be excluded from Plant Materials upon mutual consent of Agency and
<br /> 434 Contractor.
<br /> 435 Premise
<br /> 436 "Premise" means any land, or building where Solid Waste, Recyclable Materials, or Organic
<br /> 437 Materials is generated or accumulated.
<br /> 438 Previous Contractor
<br /> 439 "Previous Contractor" means Allied Waste Services of San Mateo County, a division of Republic
<br /> 440 Services, Inc.
<br /> 441 Proposal
<br /> 442 "Proposal" means Contractor's Proposal.
<br /> 443 Rates
<br /> 444 "Rates" means the monetary amounts to be charged to a Customer by Agency for providing
<br /> 445 Collection of Solid Waste, Recyclable Materials, Organic Materials, and other materials.
<br /> 446 Rate Year
<br /> 447 "Rate Year" means the twelve -month period, commencing January 1 of one year and
<br /> 448 concluding December 31 of the same year, for which Contractor's Compensation is calculated.
<br /> 449 Recycling
<br /> 450 "Recycling" means the process of sorting, cleansing, treating and reconstituting materials that
<br /> 451 would otherwise be Disposed of at a landfill for the purpose of returning such materials to the
<br /> 452 economy in the form of raw materials for new, reused or reconstituted products.
