. • <br /> 218 ARTICLE 5 COLLECTION SERVICES <br /> 219 5.01 GENERAL <br /> 220 The work to be performed and services to be provided by Contractor includes the <br /> 221 furnishing of all labor, supervision, equipment, materials, supplies, and all other items <br /> 222 necessary to perform the work and provide the services described, at the times and in <br /> 223 the manner required by this Agreement. The enumeration of, and specification of <br /> 224 requirements for, particular items of labor, supervision, equipment, materials or supplies <br /> 225 shall not relieve Contractor of the duty to furnish all others, as may be required, whether <br /> 226 enumerated elsewhere in the Agreement or not. <br /> 227 Contractor shall perform the work and provide the services pursuant to this Agreement in <br /> 228 a thorough and professional manner so that the residents and businesses within the <br /> 229 Agency are provided reliable, courteous, and high - quality service at all times. The <br /> 230 enumeration of, and specification of requirements for, particular aspects of service <br /> 231 quality shall not relieve Contractor of the duty of accomplishing all other aspects in the <br /> 232 manner provided in this Article, whether such other aspects are enumerated elsewhere <br /> 233 in the Agreement or not. <br /> 234 Provided that this Agreement is executed on or before May 1, 2010, Contractor agrees <br /> 235 that it will have sufficient time to take all steps necessary to provide all services <br /> 236 described in this Article 5 commencing January 1, 2011. Contractor shall order <br /> 237 equipment, hire employees, obtain permits and licenses, initiate public education and <br /> 238 Recycling Blitz programs, and complete all of the steps necessary to implement an <br /> 239 orderly transition as specified in the Implementation Plan (Attachment L). <br /> 240 <br /> 241 5.02 SOLID WASTE COLLECTION <br /> 242 Contractor acknowledges that the Agency is committed to diverting materials from <br /> 243 Disposal through the implementation of source reduction, reuse, Recycling, and <br /> 244 composting programs and that the Agency may, at some time in the future, implement, <br /> 245 in accordance with Section 15.12, new programs that may impact the overall quantity or <br /> 246 composition of Solid Waste to be Collected by Contractor. <br /> 247 A. Single - Family Dwelling (SFD). Contractor shall Collect Solid Waste from SFD <br /> 248 once per week from Contractor - provided Carts. Contractor shall provide <br /> 249 unscheduled Collection service within one (1) Business Day of Customer's request <br /> 250 and shall be entitled to bill Customer as specified in Attachment Q. Contractor shall <br /> 251 provide each Customer with Carts as specified in Section 8.05. Approximately one <br /> 252 (1) month prior to distribution of SFD Solid Waste Carts, Contractor shall mail a <br /> 253 notice to each SFD Customer indicating that the Customer will receive the default <br /> 254 Solid Waste Cart size specified in Attachment D, unless the Customer responds to <br /> 255 the notice (i.e., by mail, email, phone or website form) and requests an alternate <br /> 256 Cart size by selecting the preferred size. <br /> 257 Contractor shall Collect Carts Curbside unless: (i) the Occupant is provided a <br /> 258 Special Handling Service exemption; or, (ii) the Customer has requested Backyard <br /> 259 Collection Service and has agreed to pay the premium service Rate approved by <br /> 260 the Agency. The Rate charged by Agency shall be based on Contractor's cost as <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 10 of 115 <br />
