• • <br /> II <br /> 1167 1 Disincentives shall only be assessed for the last six (6) months of Rate Year <br /> 1168 One. <br /> 1169 2 "TBD" means "to be determined" and shall equal the arithmetic average of the <br /> 1170 Measured Contamination Levels calculated for four (4) quarters of samples of <br /> 1171 Single - Family Targeted Recyclable Materials taken pursuant to Attachment <br /> 1172 E -2 during Rate Year One (2011). <br /> 1173 The Measured Contamination Level for each category will be determined through <br /> 1174 sampling of loads of Recyclable Materials, Organic Materials, and Plant Materials <br /> 1175 generated within the SBWMA Service Area and delivered to the Shoreway <br /> 1176 Recycling and Disposal Center. The methodology for sampling is set forth in <br /> 1177 Attachment E -2. For purposes of assessing performance disincentives, the <br /> 1178 Contamination Level of each material category shall be the arithmetic average of <br /> 1179 the Measured Contamination Level of the samples of such material category <br /> 1180 taken during each calendar quarter pursuant to Attachment E -2. Under no <br /> 1181 circumstances shall samples taken pursuant to Section 6.02.0 be used for <br /> 1182 purposes of assessing performance disincentives. <br /> 1183 If the Measured Contamination Level for a material category in any quarter <br /> 1184 exceeds the applicable maximum Contamination Level in Table 1, Contractor <br /> 1185 shall be assessed disincentives in the amounts specified in Attachment 1 <br /> 1186 (Performance Incentives and Disincentives). Contractor shall remit <br /> 1187 Contamination - related disincentive payments to SBWMA quarterly, as provided <br /> 1188 in Section 9.06. <br /> 1189 No disincentive will be assessed for exceeding the maximum Contamination <br /> 1190 Level for Single Family Targeted Recyclable Materials during the first six (6) <br /> 1191 months of Rate Year One (2011). <br /> 1192 The maximum Contamination Level for Single - Family Targeted Recyclable <br /> 1193 Materials applicable during Rate Years Two (2012) through Ten (2020) shall be <br /> 1194 equal to the arithmetic average of the Measured Contamination Levels calculated <br /> 1195 for four (4) quarters of samples of Single - Family Targeted Recyclable Materials <br /> 1196 taken pursuant to Attachment E -2 during Rate Year One (2011). (As provided in <br /> 1197 Attachment E -2, twelve (12) such samples will be taken in each calendar quarter <br /> 1198 and forty eight (48) such samples will be taken each year, unless Contractor <br /> 1199 requests and pays for additional samples to be taken pursuant to Attachment E- <br /> 1200 2, Section 3.) <br /> 1201 C. Inspecting for Excessive Contamination in Single Loads of Recyclable <br /> 1202 Materials. <br /> 1203 The Operator will inspect loads of materials delivered to the Shoreway Recycling <br /> 1204 and Disposal Center.
