If the plan is determined to <br /> 2099 inadequately address the unsatisfactory performance as documented by <br /> 2100 observations and Complaints, the Agency may direct Contractor to revise the plan <br /> 2101 incorporating any changes into a revised plan and review said revised plan with the <br /> 2102 Agency within thirty (30) Days of the initial meeting with the Agency. <br /> 2103 C. Contingency Plan. Contractor shall submit to Agency ninety (90) Days prior to <br /> 2104 Commencement Date, a written contingency plan demonstrating Contractor's <br /> 2105 arrangements to provide vehicles and personnel and to maintain uninterrupted <br /> 2106 service during breakdowns, and in case of natural disaster or other emergency, <br /> 2107 including the events described in Section 14.09. <br /> 2108 8.02 COLLECTION STANDARDS <br /> 2109 A. Implementation of Services. The Contractor's implementation of the services <br /> 2110 required by this Agreement shall occur in a smooth and seamless manner so that <br /> 2111 Customers and /or Generators do not experience disruption in Collection services <br /> 2112 when services are initiated on the Commencement Date. Contractor shall be <br /> 2113 responsible for managing implementation of new Collection services and other <br /> 2114 related services and shall do so in accordance with the Implementation Plan <br /> 2115 prepared by the Contractor and incorporated into this Agreement as Attachment L. <br /> 2116 B. Servicing Containers and Missed Pick -Ups <br /> 2117 1. General. Contractor shall Collect the contents and return each Container to the <br /> 2118 location where the Occupant properly placed the Container for Collection. <br /> 2119 Contractor shall place the Containers upright with lids properly closed and <br /> 2120 secured. <br /> 2121 Contractor shall use due care when handling Containers. Contractor shall not <br /> 2122 throw, roughly handle, damage, or break Containers. <br /> 2123 Upon Customer request, Contractor shall provide special services including: <br /> 2124 unlocking and locking Containers; accessing locked Container enclosures (e.g., <br /> 2125 with a key or combination lock); and pulling or pushing Containers to the <br /> 2126 Collection vehicle. Contractor shall provide the special services described in <br /> 2127 this paragraph upon request from Customer and Contractor shall be entitled to <br /> 2128 bill Customer as specified in Attachment Q. <br /> 2129 2. Missed Pick -Ups. When notified of a missed pick -up, Contractor shall Collect <br /> 2130 the Solid Waste, Targeted Recyclable Materials, or Organic Materials on the <br /> 2131 day the notice is received, if possible, and in all cases shall Collect the missed <br /> 2132 pick -up by 6:00 p.m. of the next Business Day following receipt of the missed <br /> 2133 pick -up notification. <br /> 2134 C. New Customers and Change in Service Levels. Contractor shall deliver <br /> 2135 Containers and initiate Collection services for a new Customer within five (5) <br /> 2136 Business Days of the Customer's request for service. If an existing Customer <br /> 2137 requests a change in the number or size of their Solid Waste, Recyclable Materials, <br /> 2138 or Organic Materials Containers and /or frequency of Collection, the Contractor shall <br /> 2139 deliver additional Containers and /or remove Containers and shall initiate changes in <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 54 of 115 <br />
