Separate Collection of Materials and Allocation of Agency Materials. 2143 Contractor shall separately Collect and segregate Solid Waste, Targeted 2144 Recyclable Materials, and Organic Materials from each other and shall not 2145 Commingle these materials at any time during the transportation or delivery of those 2146 materials to the Designated Transfer and Processing Facility. Solid Waste, 2147 Targeted Recyclable Materials, and Organic Materials Collected in the Agency, 2148 which are combined with materials Collected from other SBWMA Member 2149 Agencies, shall be allocated by Contractor to the Agency's Collection program 2150 based on volume or Tonnage using a method approved by the Agency and 2151 SBWMA. Contractor shall not collect materials from within Agency in the same 2152 Collection vehicles used to provide Collection service to non -SBWMA Member 2153 Agencies, unless provided written approval by Agency. 2154 E. Setout Instructions to Customer. Contractor shall instruct Customers as to any 2155 preparation of Solid Waste, Targeted Recyclable Materials, or Organic Materials 2156 and the proper placement of Containers. If Customers are not adhering to 2157 Contractor's instructions, Contractor shall notify such Customers in writing. In 2158 cases of extreme or repeated failure to comply with the instructions, Contractor may 2159 decline to pick -up the Targeted Recyclable Materials or Organic Materials provided 2160 that Contractor leaves an adequate number of non - collection notices on the 2161 Container, as determined by the Agency, indicating the reason for refusing to 2162 Collect the material. Such notices shall also identify the steps Generator must take 2163 to recommence Collection service. 2164 F. Non - Collection Notices. Contractor may choose not to Collect materials for the 2165 following reasons: (i) Source Separated or Targeted Recyclable Materials or 2166 Organic Materials do not comply with the allowable Contamination thresholds; (ii) 2167 materials contain Hazardous Waste; or (iii) the loaded weight of a Container 2168 exceeds the maximum load limit specified by the Cart manufacturer and specified in 2169 Attachment D. In such case, Contractor shall issue non - collection notices stating 2170 the reason(s) the materials were not Collected. The non - collection notice shall be 2171 affixed prominently onto the Cart to ensure that it is not inadvertently removed from 2172 Cart due to weather conditions. The non - collection notices must be protected from 2173 rain, if precipitation is present or forecasted, by placing the notice in a clear plastic 2174 bag prior to affixing to Cart. 2175 Contractor shall document the use of non - collection notices by recording the date 2176 and time of issuance, address of service recipient, reason(s) for issuance, name of 2177 employee who issued the notice, and truck and route numbers. The notice shall 2178 conform to the requirements specified in Section 6.03.A, be at least two inches by 2179 six inches (2" x 6 ") in size and shall be approved by the SBWMA. The non - 2180 collection notices must identify the steps the Generator must take to recommence 2181 Collection service. In the event a Container is not collected due to excessive 2182 Contamination and Customer does not take the necessary steps to recommence 2183 Collection service, Customer shall be assessed a fee approved by Agency for 2184 Collection of the Container as Solid Waste by Contractor. This additional fee 2185 charged to Customer may include: (i) a return trip charge and (ii) a extra Solid 2186 Waste Collection charge.
