• • 2232 this Agreement, or any rights or remedies which may accrue to Agency by reason of 2233 Contractor's acts or omissions to act hereunder. Contractor is required to repair 2234 damage and /or resolve claims regarding damage to property within thirty (30) Days 2235 of receipt of the Complaint. 2236 I. Litter Abatement 2237 1. Minimization of Spills. If any Solid Waste, Targeted Recyclable Materials, or 2238 Organic Materials are spilled or scattered during Collection or transportation 2239 operations, the Contractor shall promptly clean up all spilled and scattered 2240 materials. Contractor shall use due care to prevent vehicle oil, vehicle fuel, or 2241 other liquids from being spilled during Collection or transportation operations 2242 including maintenance of the Collection vehicles to minimize and correct any 2243 leaks. Contractor shall ensure that all liquid spills or leaked liquids fluids are 2244 cleaned up promptly on the same day that they occur. 2245 Contractor shall not transfer loads from one vehicle to another on any public 2246 street, unless it is necessary to do so because of mechanical failure, 2247 emergency (e.g., combustion of material in the vehicle), accidental damage to 2248 a vehicle, or unless approved by the Agency. 2249 2. Clean -Up. During Collection operations, the Contractor shall clean -up litter in 2250 the immediate vicinity of any Container storage area (including the areas where 2251 Containers are delivered for Collection) if Contractor's actions are the cause of 2252 the litter. Each Collection vehicle shall be equipped with protective gloves, a 2253 broom, and shovel at all times for cleaning up litter. Absorbent material shall 2254 be carried on each Collection vehicle at all times and used by Contractor for 2255 cleaning up liquid spills. The Contractor shall document and discuss instances 2256 of repeated spillage not caused by it with the Customer where spillage occurs, 2257 and Contractor shall report such instances to Agency. If the Contractor has 2258 attempted to have a Customer stop creating spillage but is unsuccessful, the 2259 Agency will attempt to rectify such situation with the Customer. Contractor 2260 shall coordinate with Agency regarding Agency street cleaning activities to 2261 minimize litter. 2262 3. Covering of Loads. Contractor shall cover all open Drop Boxes with an 2263 Agency- approved cover, at the Collection location before transporting materials 2264 to the Designated Transfer and Processing Facility. 2265 J. Noise. All Collection operations shall be conducted as quietly as possible and shall 2266 conform to applicable federal, State, County, and Agency noise level regulations. 2267 Contractor shall promptly resolve any Complaints of noise to the satisfaction of the 2268 Agency. 2269 K. Route Books and Route Maps. For each Collection route, Contractor shall 2270 maintain a route book and route map that documents each Customer on the route, 2271 their service address, service level, and the order in which Customers shall be 2272 serviced (e.g., the order in which routes shall be driven). Contractor shall distribute 2273 new route books and route maps to its Collection vehicle drivers as frequently as 2274 necessary; and each driver shall note differences in the service levels shown in the 2275 route book, adding and subtracting Customers and service levels, as necessary. 2276 Route supervisors shall periodically check the routes to ensure that drivers are 2277 providing service in accordance with their route books.
