• • <br /> 2232 this Agreement, or any rights or remedies which may accrue to Agency by reason of <br /> 2233 Contractor's acts or omissions to act hereunder. Contractor is required to repair <br /> 2234 damage and /or resolve claims regarding damage to property within thirty (30) Days <br /> 2235 of receipt of the Complaint. <br /> 2236 I. Litter Abatement <br /> 2237 1. Minimization of Spills. If any Solid Waste, Targeted Recyclable Materials, or <br /> 2238 Organic Materials are spilled or scattered during Collection or transportation <br /> 2239 operations, the Contractor shall promptly clean up all spilled and scattered <br /> 2240 materials. Contractor shall use due care to prevent vehicle oil, vehicle fuel, or <br /> 2241 other liquids from being spilled during Collection or transportation operations <br /> 2242 including maintenance of the Collection vehicles to minimize and correct any <br /> 2243 leaks. Contractor shall ensure that all liquid spills or leaked liquids fluids are <br /> 2244 cleaned up promptly on the same day that they occur. <br /> 2245 Contractor shall not transfer loads from one vehicle to another on any public <br /> 2246 street, unless it is necessary to do so because of mechanical failure, <br /> 2247 emergency (e.g., combustion of material in the vehicle), accidental damage to <br /> 2248 a vehicle, or unless approved by the Agency. <br /> 2249 2. Clean -Up. During Collection operations, the Contractor shall clean -up litter in <br /> 2250 the immediate vicinity of any Container storage area (including the areas where <br /> 2251 Containers are delivered for Collection) if Contractor's actions are the cause of <br /> 2252 the litter. Each Collection vehicle shall be equipped with protective gloves, a <br /> 2253 broom, and shovel at all times for cleaning up litter. Absorbent material shall <br /> 2254 be carried on each Collection vehicle at all times and used by Contractor for <br /> 2255 cleaning up liquid spills. The Contractor shall document and discuss instances <br /> 2256 of repeated spillage not caused by it with the Customer where spillage occurs, <br /> 2257 and Contractor shall report such instances to Agency. If the Contractor has <br /> 2258 attempted to have a Customer stop creating spillage but is unsuccessful, the <br /> 2259 Agency will attempt to rectify such situation with the Customer. Contractor <br /> 2260 shall coordinate with Agency regarding Agency street cleaning activities to <br /> 2261 minimize litter. <br /> 2262 3. Covering of Loads. Contractor shall cover all open Drop Boxes with an <br /> 2263 Agency- approved cover, at the Collection location before transporting materials <br /> 2264 to the Designated Transfer and Processing Facility. <br /> 2265 J. Noise. All Collection operations shall be conducted as quietly as possible and shall <br /> 2266 conform to applicable federal, State, County, and Agency noise level regulations. <br /> 2267 Contractor shall promptly resolve any Complaints of noise to the satisfaction of the <br /> 2268 Agency. <br /> 2269 K. Route Books and Route Maps. For each Collection route, Contractor shall <br /> 2270 maintain a route book and route map that documents each Customer on the route, <br /> 2271 their service address, service level, and the order in which Customers shall be <br /> 2272 serviced (e.g., the order in which routes shall be driven). Contractor shall distribute <br /> 2273 new route books and route maps to its Collection vehicle drivers as frequently as <br /> 2274 necessary; and each driver shall note differences in the service levels shown in the <br /> 2275 route book, adding and subtracting Customers and service levels, as necessary. <br /> 2276 Route supervisors shall periodically check the routes to ensure that drivers are <br /> 2277 providing service in accordance with their route books.
