Not less than five (5) Business Days before <br /> 2851 the scheduled hearing date, SBWMA and Contractor shall ensure their availability to <br /> 2852 discuss the content and underlying support for such reports. <br /> 2853 SBWMA and Contractor shall attend and participate in the performance hearing. <br /> 2854 Contractor may be required to present an oral report on its performance at the <br /> 2855 performance hearing. Contractor's failure to attend and participate in the <br /> 2856 performance hearing and provide an oral presentation upon request; provide a <br /> 2857 written response to the questions or request for a self assessment report submitted <br /> 2858 by Agency or SBWMA; or submit an action plan if requested by Agency or SBWMA <br /> 2859 may result in Liquidated Damages pursuant to Attachment J. <br /> 2860 Within sixty (60) Days after the conclusion of each performance hearing, SBWMA <br /> 2861 may issue a report.
