• • <br /> 3032 Processing Facility and to other locations, as well as other information which the <br /> 3033 Agency may reasonably request. <br /> 3034 Contractor shall maintain these records for a minimum of ten (10) years after <br /> 3035 expiration or earlier termination of the Agreement. Contractor shall provide these <br /> 3036 records to Agency (upon request or at the end of the record retention period) in an <br /> 3037 organized and indexed manner rather than destroying or Disposing of them. <br /> 3038 9.04 GENERAL REPORTING REQUIREMENTS <br /> 3039 A. Purpose. Records shall be maintained and retained in forms, on media, and by <br /> 3040 methods that facilitate flexible use of data contained in them to structure reports, as <br /> 3041 needed. Reports are intended to compile recorded data into useful forms of <br /> 3042 information that can be used to, among other things: <br /> 3043 1. Evaluate Diversion performance <br /> 3044 2. Evaluate Contractor's performance <br /> 3045 3. Monitor Customer participation in Targeted Recyclable Materials and Organic <br /> 3046 Materials Collection programs and in other programs using several different <br /> 3047 performance measures <br /> 3048 4. Monitor changes in the number of Customers and Customers' service levels <br /> 3049 5. Determine needs for adjustment to programs and cost for such changes <br /> 3050 6. Evaluate customer service and Complaints <br /> 3051 7. Determine and set Contractor's Compensation and Rates <br /> 3052 B. Report Format. Contractor may propose report formats that are responsive to the <br /> 3053 objectives and audiences for each report. The format of each report shall be <br /> 3054 approved by Agency. The Agency may review and request changes to Contractor's <br /> 3055 report formats and content and Contractor shall not unreasonably deny such <br /> 3056 requests. Contractor agrees to mail a copy of all reports to the Agency, and submit <br /> 3057 all reports by e-mail in a format compatible with the Agency's software and <br /> 3058 computers so the Agency can sort and analyze data. Contractor shall provide a <br /> 3059 certification statement, under penalty of perjury by the responsible Contractor <br /> 3060 official, that the report being submitted is true and correct to the best knowledge of <br /> 3061 such official after their reasonable inquiry. <br /> 3062 C. Submittal Schedule and Instructions. Contractor shall submit monthly reports <br /> 3063 within fifteen (15) Days after the end of the reporting month. Contractor shall submit <br /> 3064 quarterly reports within thirty (30) Days after the end of the reporting quarter. <br /> 3065 Contractor shall submit annual reports within forty -five (45) Days after the end of <br /> 3066 each Rate Year. <br /> 3067 Contractor shall submit (via mail and e-mail) all reports to the person(s) designated <br /> 3068 by SBWMA and Agency. <br /> 3069 D. Failure to Report. The refusal or failure of Contractor to file any required reports, <br /> 3070 or to provide required information to Agency, or the inclusion of any materially false <br /> 3071 or misleading statement or representation by Contractor in such report shall be <br /> 3072 deemed a Contractor default as described in Section 14.01 subject to the notice and <br /> 3073 cure provisions of that section and shall subject Contractor to all remedies which <br /> 3074 are available to the Agency under the Agreement or otherwise. <br /> Franchise Agreement for Collection Services with Recology San Mateo County <br /> City of Redwood City <br /> ATTY /AGR/2010.014 <br /> 040510 Page 76 of 115 <br />
