• • <br /> 3075 E. Accuracy of Reports. The failure of Contractor to file accurate and timely reports, <br /> 3076 proposal(s), information or correspondence to Agency or SBWMA, or the inclusion <br /> 3077 of any inaccurate or misleading data, statement or representation by Contractor in <br /> 3078 such report(s), proposal(s), information or correspondence to Agency or SBWMA, <br /> 3079 shall be subject to Liquidated Damages as set forth in Attachment J. In addition, the <br /> 3080 inclusion of any materially false or misleading statement or representation by <br /> 3081 Contractor in such report shall be deemed a Contractor default as described in <br /> 3082 Section 14.01 subject to the notice and cure provisions of that section and shall <br /> 3083 subject Contractor to all remedies which are available to the Agency under the <br /> 3084 Agreement or otherwise. <br /> 3085 9.05 MONTHLY REPORTS <br /> 3086 Monthly reports shall present the information described in this Section. Each monthly <br /> 3087 report shall present the information below for that month and for each of the preceding <br /> 3088 twelve (12) months. <br /> 3089 A. Tonnage Information. Contractor shall provide the Tonnage information requested <br /> 3090 below by Service Sector on a monthly and year -to -date basis. However, the <br /> 3091 Agency reserves the right to request the monthly Tonnage data by route. <br /> 3092 1. Solid Waste. Total Solid Waste Tonnage Collected and Disposed by Service <br /> 3093 Sector. <br /> 3094 2. Targeted Recyclable Materials Services. Total Targeted Recyclable Materials <br /> 3095 Tonnage Collected and delivered for processing by Service Sector listed <br /> 3096 separately by material type Collected (e.g., Single- Stream Recyclable <br /> 3097 Materials, Source Separated Cardboard, Source Separated Paper, Used Motor <br /> 3098 Oil, Used Motor Oil Filters, etc.). <br /> 3099 3. Organic Materials Services. Total Organic Materials Tonnage Collected and <br /> 3100 delivered for processing by Service Sector listed separately by material type <br /> 3101 (e.g., Plant Materials, Food Scraps, or Organic Materials). <br /> 3102 If Contractor does not separately track Multi - Family Tonnage data, Contractor shall <br /> 3103 conduct a semi - annual or annual Tonnage assessment if requested by the Agency <br /> 3104 in accordance with Section 7.06, which involves separately Collecting and weighing <br /> 3105 Multi - Family Solid Waste, Targeted Recyclable Materials, and Organic Materials to <br /> 3106 quantify Tonnage Collected during a given week. <br /> 3107 B. Diversion Level. Contractor shall provide the monthly and year -to -date Calculated <br /> 3108 Overall Diversion Level, the monthly and year -to -date Residential Diversion Level, <br /> 3109 and the monthly and year -to -date Commercial Diversion Level (each stated as a <br /> 3110 percentage) calculated in accordance with Attachment I. In addition, Contractor <br /> 3111 shall present the calculations used to determine the diversion levels. <br /> 3112 C. Complaint, Inquiry and Service Requests Data. Contractor shall provide <br /> 3113 information on the number of Complaints, Inquiries service requests received from <br /> 3114 Customers, Generators, or other Person by category (e.g., missed pickups, noise <br /> 3115 Complaints, scheduled On -Call Bulky Item Collection Events, Overage events, <br /> 3116 Billing concerns, property damage claims, requests for information, delivery of <br /> 3117 Recycling Tote -Bags, inventory of Recycling Tote -Bags etc.).
