• • 3372 E. Contractor's Review of Billings. Pursuant to the requirements described in 3373 Section 7.01.F, Contractor shall submit a report on its review of Billings. 3374 F. Determination and Payment of Liquidated Damages. In accordance with the 3375 requirements of subsections 14.07 and 11.07.D, Contractor shall provide with its 3376 annual report, a report that identifies any non - compliance with the performance 3377 standards listed in Attachment J and includes calculation of the Liquidated 3378 Damages due. This report shall be accompanied by supporting documentation 3379 identifying Contractor's compliance or non - compliance with the specified 3380 performance standards. The report submittal shall be accompanied by a check 3381 from Contractor in the amount of the Liquidated Damages due (per Contractor's 3382 calculation and self - reporting) for the reporting period. 3383 G. Determination and Payment of Performance Incentives and Disincentives. In 3384 accordance with the requirements of subsection 11.07, Contractor shall provide with 3385 its annual report, a report that identifies any non - compliance with the performance 3386 standards listed in Attachment I and includes calculation of the Performance 3387 Incentive payments and Disincentive assessments due. Performance Incentives (in 3388 the form of increased compensation to Contractor) will be awarded by Agency for 3389 excellent performance on aspects of Solid Waste diversion, Collection service 3390 delivery and customer service as specified in Attachment I. Performance 3391 disincentives will be assessed by Agency for substandard performance on aspects 3392 of Solid Waste diversion, Collection service delivery and customer service specified 3393 in Attachment I. 3394 Payment related to Performance Incentives and Disincentives, other than those 3395 related to Contamination, are to be included in Contractor's annual Rate Application 3396 and Contractor's Compensation for the next Rate Year will be increased or 3397 decreased by the net amount of Performance Incentive payments and Disincentive 3398 assessments calculated. Performance Incentives and Disincentives shall be 3399 calculated as specified in Section 9.06.P. 3400 9.08 REQUIRED SPECIFIC REPORTING 3401 Event - specific reports shall be submitted following the occurrence of the event as 3402 described in this Section. 3403 A. Report of Accumulated Solid Waste; Unauthorized Dumping. As required by 3404 Section 7.07, Contractor shall report: (i) the addresses of any Premises at which the 3405 driver observes that Solid Waste, Targeted Recyclable Materials, and /or Organic 3406 Materials is accumulating; and (ii) the address, or other location description, at 3407 which Solid Waste, Targeted Recyclable Materials, and /or Organic Materials has 3408 been dumped in an apparently unauthorized manner. The report shall be delivered 3409 to the Agency within one (1) Business Day of such observation. 3410 B. Hazardous Waste. As required by Section 8.07, the Contractor shall notify the 3411 Agency of any Hazardous Waste identified in Containers or left at any Premises 3412 within twenty -four (24) hours of identification of such material. 3413 C. Reporting Adverse Information.
