• • <br /> 3439 ARTICLE 10 FRANCHISE FEE AND OTHER FEES <br /> 3440 10.01 GENERAL <br /> 3441 The fees described in this Article shall be treated as Pass - Through Costs for the <br /> 3442 purposes of determining Contractor's Compensation and shall be recoverable through <br /> 3443 the Rates that Agency collects from Customers as provided in Section 10.04. <br /> 3444 10.02 FRANCHISE FEE <br /> 3445 In consideration of the exclusive franchise granted to Contractor by this Agreement, and <br /> 3446 to reimburse Agency for costs incurred in administering this Agreement, Contractor shall <br /> 3447 pay to Agency a Franchise Fee specified in Attachment M. <br /> 3448 10.03 OTHER FEES <br /> 3449 Agency has adopted other fees which are intended to recover the costs of services <br /> 3450 related to solid waste management, recycling, cleanliness of public streets and /or public <br /> 3451 litter and recycling containers through inclusion in solid waste /recycling collection Rates. <br /> 3452 The other fees currently in effect, or which are expected to be in effect as of January 1, <br /> 3453 2011 are also listed on Attachment M. <br /> 3454 10.04 TIME AND METHOD OF PAYMENT <br /> 3455 On or before the twentieth (20 day after the end of each month, Agency shall remit <br /> 3456 revenues received from Customers minus: (i) the amount of the Franchise Fees due to <br /> 3457 Agency on Gross Revenues Billed during the immediate previous month, (ii) payments <br /> 3458 by Agency to SBWMA for deliveries to Shoreway, and (iii) other fees, including one - <br /> 3459 twelfth of any other fee established by Agency, unless Agency directs a different <br /> 3460 payment schedule for such other fees. Agency's obligation to pay Contractor is <br /> 3461 expressly limited to those revenues received from Customers. <br /> 3462 Agency will provide, concurrently with the remittance of payment, a statement showing <br /> 3463 the calculation of each fee for that month. Payments from Agency to Contractor shall be <br /> 3464 made by a method mutually acceptable to Agency and Contractor. <br /> 3465 10.05 ADJUSTMENTS TO FEES; ADDITIONAL FEES <br /> 3466 Agency may from time to time adjust the amount of the fees described in this Article and <br /> 3467 may establish other fees.
