5. Priority of Federal Law <br /> <br /> If the Agency undertakes a project with federal financial assistance and <br /> consequently must provide relocation assistance and benefits as required <br /> by federal law, these Rules shall not apply; but if an oblisation to <br /> provide relocation assistance and benefits is not imposed by federal <br /> law the provisions of the Act and Rules shall apply. <br /> <br />6. Relocation Assistance Advisory Pro,ram <br /> <br /> The Agenuy shall develop and implement a relocation assistance advisory <br /> program. Such program shall be administered so as to provide advisory <br /> services which offer assistance to the relocatee to insure that: <br /> <br /> 6.1 All persons displaced from their dwellings are relocated into suit- <br /> able replacement housing, an~ <br /> <br /> 6.2 All persons displaced from their places of business are assisted in <br /> reestablishing if that is their desire with a minimum delay. <br /> <br />7. Eligibility <br /> <br /> Relocation Assistance shall be made available to persons qualified pursuant <br /> to law. <br /> <br />8. Replacement Housing Prior to Displacement <br /> <br /> 8.1 An eligible person shall not be required to move from his dwelling, <br /> unless within a reasonable period of time prior to displacement, to <br /> the extent that it can be reasonably accomplished, a comparable re- <br /> placement dwelling is reasonably available, or, where temporary quarters <br /> are required, that such are reasonably available, as determined by the <br /> Agency. <br /> <br /> 8.2 The requirements of this section shall be deemed to have been satisfied <br /> if a person is offered and refuses without Justification reasonable <br /> choices of specifically identified comparable replacement dwellings, <br /> 4etermined to be suchby the Agency. <br /> <br /> <br />
