6.3A
Page 3
change provides for more transparency in any future business transactions to bring in new
third party tons (e.g., recyclables from another city in the county).
Section 6.06 — revised language providing relief to SBR for not using B-20 biodiesel if it is
not available onsite at the Shoreway facility fueling station. Biodiesel will not be available for '
either Recology San Mateo County (RSMC) or SBR at the start of their operations due to
changes in regulatory requirements for storage of such products in the type of storage tanks
currently used at the Shoreway facility.
Section 8.05 — revised language cross-referencing existing contractual language from
Attachment 4 regarding materials recovered by SBR at the Transfer Station not counting
towards the revenue guarantee if the materials do not require onsite processing at the
Materials Recovery Facility (MRF). '
Section 8.07 — revised language providing for earlier monthly reporting of inbound tonnage I
by the fifth business day of the month. This change will facilitate the SBWMA's timely monthly
bilfing of RSMC for franchised materials hauled to the Shoreway Center.
Section 8.08 — revised language clarifying the annual revenue reconciliation process.
Attachment 3 Section 7(C) — new language noting that the hours of the Public Recycling
Center can be modified upon mutual agreement.
ALTERNATIVES
City Council may elect not to approve amendments to the Operations Agreement with SBR. '
Doing so will render the suggested amendments null and void and will leave the Operations '
Agreement as written in place, in certain instances, preventing SBR from complying with
current regulatory requirements. If eight SBWMA Member Agencies do not approve these
amendments original language in the Shoreway Operations Agreement will remain.
FISCAL IMPACT
There is no fiscal impact on the City's General Fund due to the approval of contract
amendments with SBR. The cost to provide the services covered in the Operations
Agreement are included in the collection rates established by the City Council for residential
and commercial solid waste accounts.
   i'-----'
van Boyd
Public Works rvices Director Bob Bell
Interim City Manager
ATTACHM TS
1.
