6.3A <br /> Pa e 4 <br /> 9 <br /> RESOLUTION NO. <br /> RESOLUTION APPROVING AMENDMENTS TO THE AGREEMENT FOR THE <br /> OPERATION OF THE SHOREWAY RECYCLING AND DISPOSAL CENTER <br /> WHEREAS, the City of Redwood City is a member agency of the South Bay Waste <br /> Management Authority ("SBWMA"), a joint powers agency organized under the Joint Exercise <br /> of Powers Act by cities and other local government agencies in San Mateo County (the <br /> "Member Agencies"), each of which oversees the collection of solid waste and recyclable <br /> materials within its jurisdiction; and <br /> WHEREAS, SBWMA owns and oversees the operation of the Shoreway Recycling <br /> and Disposal Center in San Carlos ("Shoreway Center"), which is operated by a contractor, <br /> South Bay Recycling, LLC. The recycling and material recovery operations conducted at the <br /> Shoreway Center are an integral component of each of the Member Agencies' Source <br /> Reduction and Recycling Elements, which have in turn been incorporated into San Mateo <br /> County's Integrated Waste Management Plan; and <br /> WHEREAS, on July 23, 2009 the SBWMA Board of Directors approved the Shoreway <br /> Operations Agreement; and <br /> WHEREAS, on August 24, 2009 the City Council of the City of Redwood City <br /> approved the Shoreway Operations Agreement; and <br /> WHEREAS, on October 28, 2010 the SBWMA Board of Directors approved <br /> amendments to the Shoreway Operations Agreement, in order to conform the Agreement to <br /> recent regulatory changes and to clarify the responsibilities of the contractor and SBWMA. <br /> NOW, THEREFORE, BE IT RESOLVE <br /> D BY CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY AS FOLLOWS: <br /> 1. The City Council of the City of Redwood City approves the amendments ta the <br /> Agreement for Operation of the Shoreway Recycling and Disposal Center between the <br /> SBWMA and South Bay Recycling, LLC ("Agreement"). Provided, however, that the revised <br /> Agreement shall not become effective unless and until at least eight (8) of the Member <br /> Agencies approve the Agreement as provided in Section 7.1.1 of the SBWMA First Amended <br /> and Restated Joint Exercise of Powers Agreement. <br /> * * * <br /> ATTY/RESOIRES0.2072 <br /> 112910 <br />
