ATTACP ge 41 <br /> THEIMPROVEMENTS <br /> Eligible Facilities <br /> The Bonds will provide a funding source to the Developer for moneys expended for a <br /> portion of the cost of the Improvements and for certain impact and off and on-site development <br /> fees to be paid by the Developer. <br /> The Improvements eligible to be financed by the District are set forth in the Resolution of <br /> Intention and in the Community Facilities District Report (the "CFD Report") dated September <br /> 3, 2010 prepared for the City by David Taussig & Associates, Inc., Newport Beach, California, in <br /> connection with the formation of the District. <br /> The eligible Improvements authorized are described in the CFD Report as follows. I� <br /> Fees: <br /> a. All development impact fees set forth in Exhibit D to the <br /> development agreement between the City and R.C. Peninsula Park, LLC, dated ', <br /> February 13, 2008, as it may be amended or supplemented (the "Development <br /> Agreement"), including, but not limited to, potable water fees; sanitary sewer <br /> fees; water capacity fees; and traffic impact fees, and public works review and <br /> inspection fees related to the public facilities. <br /> b. Subject to the completion of a Joint Community Facilities <br /> Agreement ("JCFA"), all school fees paid with respect to property within CFD No. <br /> 2010-1 (One Marina). <br /> Public Facilities: <br /> a. Any and all CFD No. 2010-1 (One Marina) costs, including <br /> payment of equivalent dwelling unit (EDU) fees, associated with the construction <br /> of or CFD No. 2010-1 (One Marina) financial contribution to any "All Zones, Zone <br /> A, Zone B, Zone C, or Zone D East 101 Public Infrastructure Requirements as <br /> set forth in Exhibit D to the Development Agreement, including, but not limited to: <br /> • The Blomquist Bridge extension; <br /> • The Highway 101 pedestrian undercrossing; <br /> • All grading, temporary access roads, erosion control, sanitary <br /> sewer, potable water, storm sewer, reclaimed water, natural gas <br /> line; communication lines; electrical facilities; street lights; <br /> pedestrian lights; pedestrian walkways; tandscape; signage; <br /> paving, curb and gutter; striping; erosion control; or other <br /> improvements necessary to construct or reconstruct Bair Island <br /> Road including all planning, design, construction supervision; , <br /> geotechnical; survey and overhead design review and inspection <br /> fees necessary to complete same; <br /> • East Bayshore Road pavement; <br /> • New potable water lines under Highway 101; <br /> • Regional water storage tank including land acquisition; <br /> • Sanitary sewer pump station; <br /> -27- <br />
