Any and all facilities to be located within public utility or street <br /> easements, which easements are dedicated to the City or for the benefit of the <br /> "public," or flood control improvements, to include but not be limited to: <br /> • Fill and bank improvements; <br /> • On site parks and appurtenances; <br /> • Boat launches; <br /> • Outer Esplanade; <br /> • Village Walk; <br /> • Potable water lines and appurtenances; <br /> • Sanitary sewer lines and appurtenances; and <br /> • Storm sewer lines and appurtenances including bio-swales. <br /> c. Costs associated with the South Bayside System Authority <br /> To the extent not already sfated above, the facilities to be financed may include the <br /> costs of the acquisition of right-of-way or easements (including right-of-way that is intended to <br /> be dedicated by the recording of a final map), the costs of design, engineering and planning, the <br /> costs of any environmental or traffic studies, surveys or other reports, costs related to <br /> landscaping and irrigation, soils testing, permits, plan check and inspection fees, insurance, <br /> bonding, legal and related overhead costs, coordination and supervision, relocation of existing <br /> facilities, and any other costs or appurtenances related to any of the foregoing facilities or other <br /> incidental costs, whether performed prior to or after the formation of CFD No. 2010-1 (One <br /> Marina). <br /> Other: <br /> a. Bond related expenses, including underwriters discount, appraisal fees, <br /> reserve fund, capitalized interest, letter of credit fees and expenses, financial <br /> advisor fees and expenses, bond and disclosure counsel fees and expenses, <br /> fees and expenses of the City Attorney, bond remarketing costs, and all other <br /> incidental expenses. <br /> b. Administrative fees of the City and the bond trustee or fiscal agent <br /> related to the District and the bonds. <br /> c. Reimbursement of costs related to the formation of the District <br /> advanced by the City, the landowner in the District, or any party related to any of <br /> the foregoing, as weil as reimbursement of any costs advanced by the City, the <br /> landowner in the District or any party related to any of the foregoing, for facilities, <br /> capital related fees or other purposes or costs of the District. <br /> The preceding public facilities are all facilities which the City is authorized, pursuant to <br /> the agreement meeting the requirements of Section 53316.2 of the Act or otherwise (the "Joint <br /> Community Facilities Agreement") to own, construct, or finance, and which are required to <br /> -28- <br />
