ATTAC Page 42 • Storm sewer pump station; and • Any planning, design, review fees, permit, inspection, construction observation, overhead, as built drawings; and other third party costs to include entities controlled by a public utilities commission and the like associated with the construction and completion of the facilities. b. Any and all facilities to be located within public utility or street easements, which easements are dedicated to the City or for the benefit of the "public," or flood control improvements, to include but not be limited to: • Fill and bank improvements; • On site parks and appurtenances; • Boat launches; • Outer Esplanade; • Village Walk; • Potable water lines and appurtenances; • Sanitary sewer lines and appurtenances; and • Storm sewer lines and appurtenances including bio-swales. c. Costs associated with the South Bayside System Authority To the extent not already sfated above, the facilities to be financed may include the costs of the acquisition of right-of-way or easements (including right-of-way that is intended to be dedicated by the recording of a final map), the costs of design, engineering and planning, the costs of any environmental or traffic studies, surveys or other reports, costs related to landscaping and irrigation, soils testing, permits, plan check and inspection fees, insurance, bonding, legal and related overhead costs, coordination and supervision, relocation of existing facilities, and any other costs or appurtenances related to any of the foregoing facilities or other incidental costs, whether performed prior to or after the formation of CFD No. 2010-1 (One Marina). Other: a. Bond related expenses, including underwriters discount, appraisal fees, reserve fund, capitalized interest, letter of credit fees and expenses, financial advisor fees and expenses, bond and disclosure counsel fees and expenses, fees and expenses of the City Attorney, bond remarketing costs, and all other incidental expenses. b. Administrative fees of the City and the bond trustee or fiscal agent related to the District and the bonds. c. Reimbursement of costs related to the formation of the District advanced by the City, the landowner in the District, or any party related to any of the foregoing, as weil as reimbursement of any costs advanced by the City, the landowner in the District or any party related to any of the foregoing, for facilities, capital related fees or other purposes or costs of the District. The preceding public facilities are all facilities which the City is authorized, pursuant to the agreement meeting the requirements of Section 53316.2 of the Act or otherwise (the "Joint Community Facilities Agreement") to own, construct, or finance, and which are required to -28-
