• <br /> CITY shall maintain in full force and effect, until completion and final acceptance of the <br /> Project, the applicable policies of insurance set forth below. CITY shall also require any <br /> contractor providing services for the Project ( "Contractor ") to maintain in full force and <br /> effect, until completion and final acceptance of the Project, the specific policies of <br /> insurance set forth below. For purposes of this section 4.2, the term "Contractor" shall <br /> mean any individual or business entity engaged to design, build, maintain, repair, <br /> improve or operate the Project. Notwithstanding the foregoing, the term "Contractor" <br /> shall exclude any individual or business entity under contract to perform services for <br /> CITY at the time of execution of this Agreement. <br /> The insurance requirements specified in this section shall apply to Contractor and any <br /> subcontractors, suppliers, temporary workers, independent contractors, leased employees, or <br /> any other persons, firms or corporations that Contractor authorizes to work under the <br /> Contract (hereinafter collectively referred to as "Agents "). CITY shall require Contractor to <br /> procure and maintain at its sole cost and expense the insurance coverages subject to all of the <br /> requirements set forth below. Such insurance shall remain in full force and effect throughout <br /> the term of the Contract. To the extent that any Agent does not procure and maintain such <br /> insurance coverage, Contractor shall be responsible for said coverage and assume any and all <br /> costs and expenses that may be incurred in securing said coverage or in fulfilling <br /> Contractor's indemnity obligation as to itself or any of its Agents in the absence of coverage. <br /> Contractor and agents shall be responsible for payment of any deductibles or retentions on <br /> their policies without right of contribution from the TA. Any deductible and retention <br /> provisions shall not contain any restrictions as to how or by whom any deductible or <br /> retention is paid. Any deductible or retention provision shall not limit payment to the <br /> Named Insured. In the event that a policy of the Contractor or any Agent contains a <br /> deductible or self - insured retention, and in the event that the TA seeks coverage under such <br /> policy as an additional insured, Contractor shall satisfy such deductible or self - insured <br /> retention to the extent of loss covered by such policy, for a lawsuit arising from or connected <br /> with any alleged act or omission of Contractor, Agent, or any of their officers, directors, <br /> employees, agents, or suppliers, even if Contractor or Agent is not a named defendant in the <br /> lawsuit. Prior to commencing work, Contractor shall provide the CITY with a certificate <br /> evidencing coverage. The certificate shall also show that the Contractors' policy(ies) will not <br /> be cancelled or coverage altered without 30 days prior written notice to the CITY. <br /> Minimum Types and Scope of Insurance: <br /> i. Workers Compensation and Employers' Liability Insurance. Workers Compensation <br /> with Statutory Limits. Such insurance shall include a waiver of subrogation. <br /> Employer's Liability coverage with minimum limits of $1 million. <br /> ii. Commercial General Liability Insurance. Commercial General Liability <br /> insurance for bodily injury and property damage coverage with a combined single <br /> limit for bodily injury and property damage of at least $1 million per occurrence <br /> or claim and a general aggregate limit of at least $2 million.
