AFFIDAVIT OF ERIC LOCHTEFELD AND LORI LOCHTEFELD DISCLOSING REAL PROPERTY AND BUSINESS INTERESTS IN THE DOWNTOWN REDEVELOPMENT AREA OF THE CITY OF REDWOOD CITY I/We, Eric Lochtefeld and Lori Lochtefeld, declare as follows: 1. UWe are owners of Fox Theater LLC, a limited liability company. 2. I/We own the real property known as the Fox Theater located at 2215 Broadway Street, Redwood City, California, 94063. 3. I/We operate the Fox Theater as co- owners of Fox Theatre LLC and as such, hold a business interest therein. 4. I/We are informed and believe that the Fox Theater is located within the Downtown Subarea of the Redwood City Redevelopment Agency Project Area. 5. The Fox Theater is directly across Broadway Street from Courthouse Square, a property which is leased and managed by the City of Redwood City for purposes of providing a public gathering place. 6. I/We make these representations for the purpose of disclosing an interest in real property and a business /financial interest as it relates to an agreement between Fox Theater, LLC and the Redwood City Redevelopment Agency (RDA). The Agreement for Professional Services, dated l /ZN )11 ( "Agreement ") requires disclosure of any ancillary interest in real property, business, or income that will be affected by the Agreement. 7. The purpose of the Agreement is to solicit sponsorship funds for certain events funded by the RDA and held open to the public at Courthouse Square. 8. I /We hold such interests in Fox Theater, LLC as set forth above. These business interests may be affected by the Agreement to the extent that I /we intend to solicit sponsorships for events held across the street from the Fox Theater. 9. I/We understand that this affidavit will be filed with the Executive Secretary of the Redevelopment Agency and retained with the executed Agreement. I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.
